In determining whether or not diversion is appropriate, the City Prosecutor will consider a number of factors. Some of these factors include:
- The nature of the violation and the circumstances surrounding it.
- Any special characteristics and circumstances of the defendant.
- Whether the defendant is a first time offender.
- Whether the diversion program is appropriate to the needs of the defendant.
- The impact of diversion on the community.
- Recommendations of the housing code inspectors.
- Any mitigating or aggravating circumstances surrounding the violation.
Only individuals who have not been convicted of a housing code violation within the last three years are eligible to participate in the housing diversion program.
You must apply for Diversion within sixty (60) days from your arraignment in Municipal Court and pay the $25.00 non-refundable application fee.
