Rule 2: Definitions

As used in these rules, and unless the context requires otherwise, the following definitions shall supplement those definitions found in K.S.A. 12-4113:

"Administrative Traffic Court" means any duly appointed Administrative Hearing Officer, sitting as a Division to hear traffic cases, including any Administrative Hearing Officer Pro Tempore appointed for a particular case, docket, division or session of the municipal court.

"Court" means any duly appointed Municipal Judge, sitting as a Division to hear such cases, of the Municipal Court of Wichita, Kansas, including any Judge Pro Tempore appointed for a particular case, docket, division or session of the municipal court.

"Court Clerk" means the duly appointed Clerk of the Municipal Court of Wichita, Kansas, or any duly designated deputy thereof as designated by the Municipal Court Administrator or by the City Council of the City of Wichita, Kansas.

"Criminal Offense" means any act or omission defined by City Code or City Ordinance and for which, upon conviction, imprisonment or fine, or both imprisonment and fine, is authorized, or in the case of a traffic infraction, a fine is authorized.

"Legal Holidays" shall be as provided by the City Council of the City of Wichita, Kansas.

"Prosecutor" shall mean any attorney duly designated by the City Attorney of Wichita, Kansas, to represent said City in the prosecution of a defendant for the violation of any duly adopted City Ordinance or who is authorized on behalf of the City of Wichita by the City Attorney to appear in any civil proceeding within the jurisdiction of the Municipal Court.

"Traffic Offense" means any criminal offense which relates to the regulation of traffic on the roads, highways or streets or the operation of self-propelled or nonself-propelled vehicles of any kind and for which, upon conviction, imprisonment or fine, or both imprisonment and fine, is authorized or in the case of a traffic infraction, a fine is authorized. | Back to Top
