Minutes -- approved The minutes of the regular meeting of March 21, 2000, were approved 7 to 0. PUBLIC AGENDA Pat Richardson - Plumbing Board Resolution. Pat Richardson Pat Richardson, Chairman of the Plumbing Board, presented a Resolution of the Board of Plumbing and Appeals in support of uniform statewide certification of the plumbing and mechanical industry as expressed in State of Kansas Senate Bill No. 666. Mayor Knight Mayor Knight asked that this matter be referred to the City Manager and Staff, and be returned to the City Council with recommended action. Samuel W. Kelso - Parking. Samuel W. Kelso Samuel Kelso talked regarding: ? Bus driver pay ? Bus signs being out-of-date ? Use of Century II for youth activities one time per month, at no charge ? Better use of bus advertising Bob Day - Fluoridation. Bob Day Bob Day, State Department of SRS, Division of Public Policy, said $586,000 was spent last year, through SRS, on only children's dental filings. Fluoridation would reduce that amount by 40 to 60 percent, or by $234,000 based on last year's expenditures. UNFINISHED BUSINESS LIQUOR TAX SPECIAL LIQUOR TAX FUNDS ADMINISTRATION. Deferred from March 7, 2000. Motion -- carried Pisciotte moved that this Item be deferred to March 28, 2000. Motion carried 7 to 0. NEW BUSINESS ZTM, INC. PUBLIC HEARING AND TAX EXEMPTION REQUEST - ZTM, INC. (District III) Allen Bell Financial Projects Director reviewed the Item. Agenda Report No. 00-0259. ZTM, Inc., located at 4033 Navajo Lane in southeast Wichita, was locally formed in 1996. ZTM, Inc. is a machine shop supporting Wichita’s aircraft industry. Since inception, ZTM has experienced rapid growth in sales and production. In response to an increase in production requirements, ZTM expanded its existing manufacturing facility and purchased additional equipment in 1998 after notifying the City of their intent to seek a tax exemption pursuant to the business incentive policy. ZTM requests approval of an Economic Development Tax Exemption on the 1998 expansion project. ZTM mills close-tolerance component aircraft parts in support of Wichita’s major aircraft manufacturers. ZTM also performs tooling and prototype work for the aircraft industry. ZTM utilizes sophisticated computer-controlled manufacturing equipment for their precise milling work. In 1998, ZTM expanded their existing 5,000 SF facility. The completed expansion project resulted in a new 13,917 SF manufacturing facility. ZTM’s capital investment in the new construction portion of their expansion was $500,000. ZTM also purchased 10 pieces of manufacturing equipment in the amount of $1,500,000. Total capital investment in the expansion project is $2 million. In 1998, ZTM had a total of 24 employees. At the time of the expansion project, ZTM projected job creation of at least 10 new full-time jobs in five years. ZTM has already created 10 new jobs and expects to hire additional employees as a result of their 1998 expansion project. ZTM exports 95% of all production of out Kansas via Boeing, Raytheon, and Cessna. Public hearings on tax exemption requests are typically held prior to inception of expansion projects, including new construction and purchase of new equipment. State law also allows application for tax exemption up to three years after completion of an expansion project. All applicants must provide the City written notice of intent to apply prior to any construction or purchase of equipment. ZTM provided the Office of Economic Development written notice of “intent to apply for tax exemption” prior to starting their expansion project. Kansas Board of Tax Appeals can legally consider an application for exemption up to three years subsequent to an expansion project if the applicant provided written notice prior to project start- up. ZTM’s expansion project is itemized in Exhibit I. Under the City's Business Incentives Policy, ZTM, Inc. is eligible for the following: TAX EXEMPTION ELIGIBILITY ELIGIBLE % INCENTIVE EXPLANATION 22.5% New Job Creation: ZTM has created 10 new jobs. 22.0% Capital Improvements: ZTM invested $1,500,000. 44.5% Sub Total Business - Incentive Eligibility (Maximum allowed is 50%) 47.5% Export Premium: ZTM exports 95% of its product outside Kansas. 92.0% Sub Total – Export Premium (Maximum allowed is 50%) 0.0% Location Premium: ZTM is not located in the central redevelopment area (additional 20% allowed) 92% TOTAL EXEMPTION ALLOWED UNDER BUSINESS INCENTIVE POLICY ZTM is eligible for 92% tax exemption for a five-plus-five-year term on new real and personal property. A notice of public hearing has been published. ZTM has agreed to comply with the conditions set forth in the Business Incentive Policy. The estimated first year taxes on the proposed $1.5 million project under the 1999 mill levy on property within the Wichita City limits would be $44,650. The existing building and personal property will stay on the property tax rolls. The 92% tax exemption will be shared among the taxing entities as follows: City - $12,838; County/State - $12,791; and USD 259 - $15,460. Wichita State University Center for Economic Development and Business Research calculated a cost-benefit analysis indicating benefit-to-cost ratios of 1.58 to 1 for the City of Wichita; 1.29 to 1 for Sedgwick County; 1.0 to 1 for USD 259 and 10.29 to 1 for the State of Kansas. Motion -- Lambke moved that the public hearing be closed and the Ordinance granting a 92 percent tax exemption on real and personal property improvements for a five-plus-five-year term, subject to City Council review, be placed on first -- carried reading. ORDINANCE An Ordinance exempting property from ad valorem taxation for economic development purposes pursuant to Article 11, Section 13, of the Kansas Constitution; providing the terms and conditions for ad valorem tax exemption; and describing the property of ZTM, Inc., so exempted, introduced and under the rules laid over. VOICESTREAM PUBLIC HEARING AND REQUEST FOR LETTER OF INTENT FOR INDUSTRIAL REVENUE BONDS - VOICESTREAM WIRELESS CORPORATION. (District I) Allen Bell Financial Projects Director reviewed the Item. Agenda Report No. 00-0260. VoiceStream Wireless Corporation (VoiceStream) is a Bellevue, Washington based wireless communication provider. In 1999, VoiceStream was formed by its parent company, Western Wireless. VoiceStream is a leading provider of digital wireless communications in the western United States. VoiceStream intends to construct a new 70,000 SF call center near the intersection of 21st and Woodlawn, in northeast Wichita. The call center will be leased to VS Property, L.L.C. for use by VoiceStream. VS Property, L.L.C. is requesting City Council approve a six-month Letter of Intent to issue Industrial Revenue Bonds in an amount not-to-exceed $11.5 million for benefit of VoiceStream Wireless Corporation. VS Property, L.L.C. also requests a 100% five-plus-five-year tax exemption on property purchased with bond proceeds. VoiceStream provides digital wireless communication service to over 714,000 subscribers in 23 of the 25 largest United States metropolitan areas. Some of the major markets include Seattle, WA; Portland, OR; Phoenix, AZ; Denver, CO; Austin, TX; Tulsa, OK; and, Wichita, KS. VoiceStream utilizes the Global System for Mobile Communications (GSM) for its service delivery. VoiceStream’s personal communication service is unique because GSM provides integrated voice, high speed data, fax, paging and messaging capabilities. After a planned merger with Omnipoint and Aerial Communications, VoiceStream will be the fourth largest provider of digital wireless communication in the United States. Nearly three out of every four people in the U.S. will live in areas licensed to be served by VoiceStream or its affiliates. The purpose of the new 70,000 SF call center will be to serve incoming calls regarding billing services, and other customer service questions. The new call center will feature a fitness center and dining room to facilitate at least 400 new employees. Wichita State University Center for Economic Development and Business Research has completed a cost-benefit analysis which shows the following ratios of benefits to costs: City of Wichita, 2.22 to 1; Sedgwick County, 1.62 to 1; U.S.D. 259, 2.55 to 1; and State of Kansas, 3.90 to 1. USES OF FUNDS Land $ 998,400 Building 9,092,457 Lease Commission 272,000 Cost of Issuance 387,143 Construction Interest 450,000 Contingency 300,000 Total Cost of Project: $11,500,000 It is anticipated the firm serving as the City's contract Bond Counsel at the time of issuance of these bonds will serve as Bond Counsel for the issuance of these bonds. Froggette & Company will serve as placement agent on a best efforts basis for up to $7.5 million, and the balance will be placed with VS Property L.L.C., VoiceStream Wireless Corporation or affiliates. A best efforts basis for placement of the bonds is not the usual placement method. The law firm of Triplett Woolf & Garretson, L.L.C. will act as both tenant’s and placement agent’s counsel. The dual counsel role will be a specific disclosure in the placement documents. VoiceStream agrees to comply with the Standard Conditions contained in the City’s IRB Policy. VoiceStream agrees to pay all costs of issuing the bonds and agrees to pay the City's $2,500 annual IRB administrative fee for the term of the bonds. VoiceStream qualifies for a 100% five-plus-five-year tax exemption on property purchased with bond proceeds. Bond documents needed for the issuance of bonds will be prepared by bond counsel. (Agenda Item 6a) WATER SYSTEM PUBLIC HEARING - PETITION TO CONSTRUCT A WATER DISTRIBUTION SYSTEM TO SERVE AN AREA SOUTH OF 63RD STREET SOUTH, WEST OF THE ARKANSAS RIVER. (District III) (This Item was previously listed as Consent Agenda Item 18b) Mike Lindebak City Engineer reviewed the Item. Agenda Report No. 00-0264. The signatures on the Petition represent 116 of 192 (60.4%) owners and 49% of the improvement district area. A February 17, 2000, neighborhood meeting was held to discuss the Petition. Sixteen property owners were present. Most indicated support for the project. The improvement district is a mixed use area that is predominantly residential in character. There are several large tracts that are undeveloped. Area residents report that the well water is poor quality. The area is planned for annexation by the City of Wichita. The estimated project cost is $1,900,000 with $1,596,000 assessed to the improvement district and $304,000 paid by the Water Utility. The Utility share is for the cost of over sizing the pipe to serve future development beyond the improvement district. The proposed method of assessment is the square foot basis. The estimated rate of assessment is $00.14 per square foot of ownership. An area property owner with a large residential lot has requested that the method of assessment be changed to the per unit basis. Residents of the Pine Bay neighborhood, a golf course/residential development, have requested that their fairway easements be removed from the improvement district. Mayor Knight Mayor Knight inquired whether anyone wished to be heard. Dave Yearout Dave Yearout said the top four signers had, by petition, requested to be excluded from the project. William Brown William Brown said he raises horses and wants water; however, the assessment for his property is $19,000 compared to $7,000 for other landowners. Mr. Brown requested some other means of assessment. Dennis Brewster Dennis Brewster stated that he has had to have his well pulled twice and has had to replace his water tank. Mr. Brewster said he really wants City water. Donna Taylor Donna Taylor said she could not the $50,000 water assessment for ten acres of land. Ray McCleve Ray McCleve spoke against assessments on the golf course reserve areas. Linda Bowman Linda Bowman said she does not want water and should not have to pay an assessment if her property is not going to be connected to City water service. Terry DeCou Terry DeCou said he had told the truth when he took the petition around for signing and had told people about agreeing to be annexed into the City of Wichita. Council Member Lambke Council Member Lambke said there are a lot of questions and situations yet to be resolved. The fairness issue needs to be addressed. Motion -- Lambke moved that the Item be deferred two weeks; and that he be allowed to meet with people in the area and -- carried staff to see whether situations can be resolved and made fair. WATER & SEWER PUBLIC HEARING ON PROPOSED ASSESSMENTS FOR TWENTY-NINE WATER, TWENTY-SIX ASSESSMENTS SEWER, AND FIFTEEN STORM SEWER PROJECTS IN THE BOND SALE FOR AUGUST 2000. Agenda Report No. 00-0261. The Council was notified on February 15, 2000, that the proposed assessment rolls were on file for public inspection in the Special Assessments Section of the City Clerk's office. Notice of hearing was published February 25, 2000, ten days prior to the date of hearing, and affected property owners have been notified in writing. City personnel held an informal hearing March 6, 2000, for the water, sewer and storm water sewer projects. Statements of Special Assessment will be mailed to the property owners on March 31, 2000. The property owners have 30 days from date of statement to pay their assessment and avoid paying interest. The assessments not paid during this period will be in the August 2000 of Bond Sale No. 760 and put on the 2000 tax roll tax roll over a 15- year spread at the interest rate for which the bonds sell. The City Attorney, on behalf of the City, has intervened or filed a complaint in several electrical company proceedings; the City is also actively participating in cases before the Kansas Corporation Commission, the Federal Energy Regulatory Commission, and the courts. The City has used the services of the law firm of Duncan & Allen to provide legal advice and assistance in electrical strategies and electrical rate proceedings under a prior contract for legal services. This Supplemental Agreement provides the continued authority for the services of the firm of Duncan & Allen for electrical power advice and representation in electrical proceedings. The agreement also covers the cost of services of expert witnesses and related expenses necessary for these proceedings. This Supplemental Agreement is for a not-to-exceed sum of $300,000. HOME REPAIR SEDGWICK COUNTY DEPARTMENT ON AGING - MINOR HOME REPAIR PROGRAM. Agenda Report No. 00-0271. The City's Housing Department provides financial assistance to low and very low-income owner/occupants of residential structures to eliminate blighting influences and deterioration of property. The financial assistance provided is in the form of low interest (direct) loans, or zero interest deferred loans. A mortgage is placed on the property in the amount of financial assistance received. This program is funded solely with Community Development Block Grant (CDBG) and HOME dollars. As of July 1, 1999, all CDBG and HOME rehabilitation dollars are only available within one of the five (5) Local Investment Area (LIA) of the City of Wichita. Sedgwick County’s Department on Aging receives County Mill Levy funds to provide financial assistance to elderly homeowners to resolve emergency situations affecting the health and/or safety of the recipient’s household. Under this proposal, the City's Housing Department will act as the “CONTRACTOR” to administer the County’s funds in providing assistance to low-income elderly homeowners within the City limits of Wichita. The Housing Department will prepare the necessary specifications, solicit bids, monitor the repairs and approve the work. The Department on Aging will determine the eligibility of the applicant and make payment to the contractor once the work has been satisfactory completed. The City's Housing Department receives frequent calls from low-income, elderly homeowners that live outside of the LIA. These low-income homeowners are experiencing housing problems such as, but not limited to, leaking roofs, inoperable furnaces, leaking water pipes, collapsed sewers, needing ramps installed, etc. The proposed contract will establish a mechanism for the Department on Aging and the Housing Department to provide financial assistance, using County funds to resolve emergency situations affecting the health and/or safety of low income elderly households outside of the LIA, but within the City. The County's fund will also be utilized as leverage to City of Wichita’s CDBG and HOME Emergency Assistance Program, Home Repair Program, and the Deferred Loan Program projects located within the LIA. The County's funding will amount to approximately $80,000 annually to the Department on Aging to operate a Minor Home Repair Program for low-income elderly homeowners in Sedgwick County. For the past fifteen (15) years Wichita Transit has filed for KCC funding to support the local rideshare program and special transportation development/coordination activities. This year’s grant, which has been submitted, will be a continuation of that effort, which includes mostly labor costs, with training and marketing, to promote all ground transportation services from buses to vans to carpools. Major employers will be targeted for some level of corporate sponsorship of public transit. Additionally, staff will be conducting continuing research on the feasibility of implementing Intelligent Transportation Systems (ITS) type of service for our operations, including the automatic vehicle locator (AVL), geographic information system (GIS), and electronic fare collection per Wichita Transit’s Operational Plan. Finally, staff will continue its brokering effort to place/match individuals for other transportation services available throughout the region. The KCC grant request is for $35,000 which is the same amount that was received last year. KCC will be used as the 20% local match to FTA (80%) funds ($140,000) for a total project cost of $175,000. The 21st Century Tourism Council recommends the hiring of the Nucifora Consulting Group as primary consultant for the development of an in-depth Regional Strategic Master Plan for Tourism in the Wichita and Southcentral Kansas Region. The Tourism Council was organized to further the direction and initiative set at the 2000 Tourism & Meetings Summit held in Wichita in August of 1999. The Summit was a cooperative effort organized by the City of Wichita, Wichita Convention & Visitors Bureau, and Regional Economic Area Partnership (REAP). The mission of the Summit was to convene key South Central Kansas leaders to focus on opportunities in tourism. The event had participants strategize on methods to obtain greater economic impact through what is projected to soon be the world’s largest industry. An 18-member Tourism Council was established to develop the Strategic Marketing Plan. The Strategic Master Plan will address the following key issues in the tourism industry: ? On September 8, 1998, the City Council approved a construction contract to build a large waterline from the City center to the northeast part of the City. In order to avoid disrupting new businesses, it is proposed that the project scope be expanded to include an additional 400 lineal feet of 36” pipe. The crossing will occur near the 21st and Webb Road intersection. Installing the crossing now will eliminate the need to remove new driveways and landscaping at a future date. (District VI) Agenda Report No. 00-0276. Mead Street from Douglas to First Street is currently under construction. There is a sanitary sewer collection system within Mead Street and the alley that lies north of Douglas, east of Mead. The sanitary sewers were constructed in 1889. The sewer in the alley was rehabilitated in 1984 by slip lining which reduced its flow capacity. The capacity of the sewer in the alley is currently overloaded. New apartments are proposed for the area which will increase the flow through the sewer, creating the possibility of sewer backups in the area. To minimize cost and disturbance to the Old Town District, it is recommended to replace the sanitary sewer in the alley east of Mead by trenchless technology while Mead Street is under construction. Nowak Construction has been contracted do the improvements for $25,120.00 using trenchless technology. The City Manager approved proceeding with the project on March 2, 2000. Capital Improvement Program, Reconstruction of Sanitary Sewers (CIP #S-4) has a budget of $3,000,000 for 2000. This repair will be funded from Sewer Utility Revenues and Reserves and/or a future revenue bond issue. Agenda Report No. 00-0277. The Water and Sewer Department is migrating from the current customer information system to an Oracle system utilizing the Windows NT operating system. Associated with this is the need to upgrade the software system used for the Itron meter reading data entry system to a Windows NT compatible software (MVRS). Upon installation of the MVRS software, it was noted by the vendor that twenty-two (22) FS2 meter reading units had one megabyte of memory rather than two megabytes required for compatibility with MVRS. More information is loaded into the meter reading units and in a different format than is currently the case with Enterprise software. Enterprise software will continue to be used until implementation of the new CIS system. This item was reviewed and approved by the MIS committee on March 9, 2000. Purchase of the memory upgrade for the reading units will cost $780 each, for a total of $17,160. There are sufficient funds in the project budget to provide for this expense. Purchasing Ordinance No. 35-856, Section 2(b) provides for the purchase of equipment and supplies from sole sources without advertising for bids. Agenda Report No. 00-0278. The Water and Sewer Department is migrating from the current customer information system to an Oracle system utilizing the Windows NT operating system. Associated with this is a change in the OCR scan line on the bills processed by Express for payment necessitated by a change in the structure of the account number which is integral to the BANNER CIS software. The contract with SCT Utility Systems, Inc., for sale and installation of the BANNER CIS(utility billing) system, was for an amount of $942,743. Of this, $15,256 was earmarked for SCT’s programming of an interface to the remittance processor in Express. In the course of designing the functional specifications for the interface, it was noted that the account number structure within BANNER would necessitate changes in the software resident on the remittance processor. A quote from Wausau Financial Services for this programming was obtained calling for expenditures of $15,170 plus expenses. This item was reviewed and approved by the MIS Committee on March 9, 2000. There are sufficient funds provided by the $100,000 contingency allocation in the project budget to provide for this expense. YOUTH PROGRAM SUMMER OF DISCOVERY YOUTH RECREATION PROGRAM. Agenda Report No. 00-0279. As part of the 2000/2001 Annual Budget, the City Council approved an expenditure appropriation of $461,510 to fund the Summer of Discovery (SOD) program in 2000. The appropriation was based on expenditure and revenue estimates made prior to implementation of the program in June 1999, and represented budgeted cost recovery of 81 percent. In 1999, the SOD program realized approximately $325,000 in revenues on slightly less than $428,000 in actual expenditures (76 percent cost recovery). In 1999, SOD was developed and implemented at the City's ten recreation centers located throughout Wichita. The program was considered to be very successful based upon surveys and comments from both parents and participating children. In an effort to further build the program and increase attendance (in 1999, 1.034 children participated in SOD) at all centers, Park staff will implement several operational changes. The changes include: 1) designating each of the individual recreation centers as registration sites; 2) having trained staff on-site to immediately qualify participants for scholarships; 3) developing a comprehensive marketing campaign to explain the program fully to potential participants and their families. These measures, coupled with an exciting and stimulating program, are expected to draw maximum participation at all ten recreation centers in 2000. The eleven-week SOD program qualifies as a child-care program and must meet state regulations requiring an adult-to-child ratio of one adult to every sixteen children. Based on these guidelines, the current budget allocation will allow the ten recreation centers where this summer youth program is offered the ability to serve only eighty children per site, although each recreation center has the capacity to serve a maximum of ninety-six children per site. A supplemental allocation of $31,110 will allow the City to serve the maximum capacity of ninety-six children at each recreation center. The 2000 Adopted budget appropriates $461,510 in expenditure authority based on projected revenues of $370,000 (slightly over 80 percent cost recovery). Based on a total expenditure budget of $492,620, SOD is projected to generate $398,400 (81 percent cost recovery) to $526,830 (107 percent cost recovery) in revenues in 2000.Budget adjustments in excess of $10,000 require City Council approval. The public sale of the aforementioned bonds and notes is scheduled for 10:30 a.m. on April 4, 2000 at which time sealed bids will be opened and the City Council will award the sale of the series of bonds and notes to the bidder whose proposed interest rates result in the lowest overall cost to the City. The City’s Spring 2000 Airport general obligation bond and note sale includes the following issues: Temporary Notes: Temporary financing will be composed of General Obligation Airport Renewal and Improvement Temporary Notes, Series A, 2000 (Tax Exempt), in the principal amount of $730,000 and Series B, 2000 (Subject to AMT) in the principal amount of $900,000. The Series B, 2000 Notes are subject to the alternative minimum tax ("AMT") because the improvements being financed directly benefit private businesses at the airports, such as the airlines. The applicant indicates that he operates a carpet business, the Carpet Smith, at 1929 Orient Boulevard which is located north of the application area and zoned “LC” Limited Commercial. The applicant is requesting approval of “LC” Limited Commercial zoning on 0.42 acres of platted property currently zoned “MF-29” Multi-Family Residential. The application area is a rectangular shaped parcel and is located at the southeast corner of the intersection of Orient Boulevard and Euclid. Merton Avenue, which is vacated, is located just south of the applicant’s business, is included in this application. Euclid Street is located on the west, apartments are located to the south and an alley is located on the eastern edge of the property. [There is a single-family dwelling and garage currently in the application area.] The applicant owns property north of the vacated Merton Avenue, that is zoned “LC” Limited Commercial and the site of the current business. The property south of the application area is zoned “MF-29,” the property east is “MF-29” and the property to the west is also “MF-29.” The “MF-29” areas have a mixture of single and multiple family residential uses. Access to the proposed site is currently from the north via Orient Boulevard and west from Euclid via an existing curb cut (what was once Merton Avenue). The existing business is a cinder block building located north of the application area. Inspection of the site revealed that the site is in need of repair and general cleanup. The site had discarded carpet and inoperable vehicles north and south of the building. From staff’s inspection, it is not clear to staff whether the business is currently operating or not. The applicant has not submitted a site plan for review. Consequently, staff is not clear on the exact nature of the applicant’s expansion plans. Lighting for the proposed facility is to be reflected away from any adjoining residential uses per zoning ordinance. Currently the parking lot on the business site is unpaved. Should the zone change be granted, the parking lot would need to be paved per zoning code requirements. The Landscaping Code requires that the site be developed with appropriate screening. Per the zoning code, a screening fence will be required along the south property line. The parking lot will need to be screened. Buffer plantings will also have to be placed along the south property line. Landscaped street yard plantings will be required along Orient Boulevard and Euclid. As part of the rezoning process, the applicant will need to submit a proposed Landscaping Plan. At the MAPC meeting held on February 24, 2000, the MAPC voted (11-0) to recommend approval subject to the Protective Overlay. The agent stated that the applicant was requesting the rezoning to expand his existing carpet business. The agent was in agreement of conditions of the Protective Overlay that limit certain uses and access control to Euclid Avenue. Issues raised by the MAPC were the current condition of the site (junk vehicles, trash, etc.). The MAPC Members suggested that the proposed commercial use would be an improvement to the area in question. There was a less than 20 percent of the area Protest Petition submitted by a neighbor in the notification area. Screening requirements are part of the zoning code and would be required as part of the plat. The applicant is requesting “TF-3” Two Family zoning for a 7.3 acre tract of land located on the south side of 45th Street North approximately one-half mile east of Rock Road. The proposed layout of the subdivision shows approximately 15 lots, for an approximate density of 4 to 5 units per acre. The site is located immediately north of Willowbend and west of Sun-Air Estates. While Willowbend and Sun-Air are both areas with single-family homes, they vary significantly in the type of development. Willowbend is a planned development that includes a golf course, country club facilities, and a strong homeowners association regulating private development within its boundaries by restrictive covenant. Sun-Air, in contrast, was platted in 1954 and developed over time with a mix of housing types, although all appear to be single-family units. From field observations, housing types in Sun-Air include conventional site-built housing, residential-designed manufactured homes, manufactured homes that would not meet residential-design standards, and even some mobile homes that could not meet post-1976 building requirements. Most of the lots are between one and 1 ½ acre in size. The Union Pacific railroad right-of-way forms the western boundary of the tract. The property between the railroad right-of-way and Rock Road is platted as 45 Rock Road Industrial Park Addition, and is occupied by an oil well and industrial service building. There is a small cemetery at the corner of Rock and 45th. The property to the north of 45th Street is in agricultural use, but a residential plat has been filed. The applicant has held discussions with the Willowbend Homeowners Association regarding mutually acceptable conditions that the developer is willing to incorporate as part of this zoning application. The proposed conditions are: 1. Building height shall be limited to 25 feet. 2. The front of each unit shall be of brick construction from ground level to a height of 4 feet as a minimum. 3. Two 3” caliper trees will be planted and maintained in the rear setback of each lot with a residential building. 4. Rooflines shall be alternated to be hipped, gabled and Dutch hipped, and the roofing material shall be Heritage II, 30 year or equivalent. 5. No wooden or chain link fences shall be allowed on the property. 6. None of the Conditional Uses listed in Wichita-Sedgwick County Unified Zoning code Article III, Section III-B,c, October 28, 1999, shall be permitted on the property. At the MAPC meeting held February 24, 2000, the agent for the applicant and a member of the Willowbend Homeowners Association were present to speak in favor of the application. There was nobody to speak in opposition. MAPC voted (10-0-1) to recommend approval, with one member abstaining due to conflict of interest. No protests have been filed. RUSSELL REQUESTS THE ANNEXATION OF PROPERTY GENERALLY LOCATED ONE-HALF MILE SOUTH OF 37TH STREET NORTH AND ONE-HALF MILE WEST OF HOOVER ROAD, TO THE CITY OF WICHITA, KANSAS. (District V) Agenda Report No. 00-0294. The City has received a request to annex a 36.4 acre area situated ½ mile south of 37th Street North and ½ mile west of Hoover Road. The westerly boundary of the site abuts the current City limits. The property owner is planning to initially develop the property with 78 single-family homes as part of a larger development concept to the west of the site. The staging of development will occur over four (4) years beginning in the year 2000. The Metropolitan Planning Commission approved the final plat of the proposed development on December 16, 1999. Land Use and Zoning: The annexation site consists of five (5) undeveloped contiguous tracts of land zoned “SF- 20” Single Family Residential. Land to the north, south and east of the site is zoned “SF-20” Single Family Residential. Land to the west of the site is zoned “SF-6” Single Family Residential. Upon annexation, the “SF-20” Single Family Residential zoning of the subject property will convert to “SF-6” Single Family Residential. Public Services: The City Water and Sewer Department indicates that the subject property will have access to a 20 inch water main that is currently being installed along the Ridge Road right-of-way, between 29th Street North and 37th Street North. As for sewer, the property proposed for annexation will have access to City sewer via a 10 inch line along the Ridge Road right-of-way, between 29th Street North and 37th Street North, that is also presently under construction. Street System: Once all stages of the development have been completed, the property proposed for annexation will have access to 37th Street North, a two-lane unimproved section line road, which serves the area as the nearest major east-west road. The site will also have access to Ridge Road, a four-lane improved section line road, which serves the area as the nearest major north-south road. Currently, there are no plans to further improve that portion of Ridge Road or that portion of 37th Street North in the City of Wichita 2000-2009 C.I.P. or the 2000-2004 Sedgwick County C.I.P. Public Safety: The Wichita Fire Department can serve this site within an eight (8) to nine (9) minute approximate response time from City Station #16 located at 1632 N. Tyler Road. Upon annexation, police protection will be provided to the area by the Patrol West Bureau of the Wichita Police Department, headquartered at 661 North Elder. Parks: Sedgwick County Park, a 480 acre regional park, is located approximately two (2) miles south of the property proposed for annexation. The park may be accessed through entrances located off 21st Street North. The Wichita-Sedgwick County Parks and Open Space Master Plan: Parks and Pathways indicates no plans for future parks near the area proposed for annexation. School District: The property is located in Unified School District 266 (Maize School District). Annexation will not change the school district. Urban Growth Area & Policy 32: The property is located outside of the urban growth area of the City of Wichita as shown in the 1996 amended Wichita-Sedgwick County Comprehensive Plan. Although the property is located outside of the current Policy 32 urban service area, the property is located within the 2010 urban service area, as proposed in the draft 1999 update to the Comprehensive Plan. The property proposed for annexation is currently vacant with the exception of a few farm related structures that will be removed prior to the development of the site. The total appraised value of the property is $32,830, resulting in an assessed value of $4,451. Using the current City levy ($31.406/$1000 x assessed valuation), this roughly yields $140 in City annual tax revenues for the unimproved property. The future assessed value of this property will depend on the timing of development, the type of development and the current mill levy. According to the evaluation sheet submitted by the property owner, the property upon 100% completion will yield an appraised value of $10,140,000, resulting in an assessed value of $1,166,100. Assuming the current City levy remains about the same ($31.406/$1000 x assessed valuation), this would roughly yield $36,623 in City annual tax revenues. Agenda Report No. 00-0295. The current contract with AMPCO Systems Airport Parking (AMPCO) will expire on March 31, 2000. The expiring contract was for a term of 51 months. Prior to 1996 the parking facilities were operated under a concession agreement. Under the management of AMPCO during the fifty-one month period, net receipts have increased by $462,142 while enplanements have decreased by 27,033. The review and analysis of the Request for Proposals from the three qualified firms discloses no significant difference between the firms. AMPCO’s management fee was $1,683 lower than the next higher proposed fee and $86,162 lower than the highest proposed fee. The parking facilities generated $2,637,655 of revenue in 1999 out of a total of $15,519,878 which represents 17 percent of the total revenue for the airports. The management fee for 1999 was $31,250. The proposed management fees are shown on the review and analysis (Item 2 – AMPCO) and average $27,739 per year under the recommended proposal. On October 25, 1999 the Wichita Airport Authority hired Professional Engineering Consultants to prepare a study for the correction of the airfield electrical vault flooding. The airfield electrical vault has experienced flooding, causing the airfield NAVAIDS, runway lights, taxiway lights, and guidance signs to be out of service; impacting the operation of the airport. This flood protecting project will include corrective work on the structure; i.e. modifying windows and vents, raising walls, etc.; exterior drainage; and corrective work on the temperature stabilizing system. The total cost of the project is estimated to be $200,000. It is anticipated that FAA grant and Passenger Facility Charges will be used to fund the project. Motion carried 7 to 0. AIRPORT PROJECT MID-CONTINENT AIRPORT GENERAL AVIATION SITE DEVELOPMENT.* Agenda Report No. 00-0299. In order to properly accommodate the further development of general aviation on Mid-Continent Airport, it is necessary to open a new development on the western boundary of the airport. At present, there is an identified demand for two, 45,000 sq.ft. hangars. The Master Plan for Mid-Continent Airport calls for the next development to occur east of Tyler Road in the vicinity of the National Weather Service facilities. A 60-acre site is available, but is only served by Tyler Road and a few utilities. In order to develop this area, which is the logical progression of development, it is necessary to undertake planning and design activities to develop roads, utilities, hangar sites, parking aprons and taxiways. The site is adjacent to two of Mid-Continent’s three runways. It is appropriate that this development take place with the use of debt financing and further the use of general obligation bonds. It is not known at present the entire cost of the development and it is, therefore, necessary to initiate planning and design studies prior to actually breaking ground. A portion of the initial studies will investigate and identify the potential funding sources and the long-term financial benefit to the airport and the community. The total planning and design costs could exceed $938,000, of which 75% may be eligible for FAA funding.
