MINUTES OF THE MEETING OF THE CITY COUNCIL Wichita, Kansas, April 8, 2003 Tuesday, 9:05 A.M. The City Council met in regular session with Mayor Knight in the Chair. Council Members Brewer, Fearey, Gale, Lambke, Martz, Pisciotte, present. Chris Cherches, City Manager; Gary Rebenstorf, Director of Law; Pat Graves, City Clerk; present. Father James J. Billinger, St. Elizabeth Ann Seton Catholic Church, gave the invocation. The pledge of allegiance to the flag was participated in by the Council Members, staff, and guests. The Minutes of the regular meeting of April 1, 2003, were approved 7 to 0. (The Consent, Planning, and Airport Agendas were approved. Actions are shown later in the Minutes.) Mayor Knight Mayor Knight recognized, local, community, County, and State guests. COMMENTS FROM MAYOR AND COUNCIL MEMBERS Council Member Gale Council Member Gale thanked God for the opportunity to serve in the City Council Member position, and said he hoped he had given the position the respect and devotion it deserved. Thanks was also given to his wife, family, and southwest Wichita citizens and District IV neighborhoods for their hard work and support. Council Member Gale said it was an honor to get to know City Staff - there is none finer and it was a great pleasure to work with them. It will be difficult to leave the City Council today and not have the interaction with Staff and Council Members. It will be good to be able to spend more time with his wife and doing other things, and continuing to work in Wichita in different capacities. Council Member Gale welcomed the new Mayor and Council Members and looks forward to their service. Council Member Pisciotte Council Member Pisciotte said there has been much change but, at the same time, much remains the same. The same core values remain as change goes on. There have been many successes - attributable directly, a great deal, to Staff and the most outstanding City Manager in the Country. Council Member Pisciotte expressed appreciation for City Council Members (both past and present), DABs, District II neighborhoods, and the Hugo Wall School and WSU. He also thanked his wife Linda who allows whining and sniveling time. A great deal has been accomplished such as air fares, electric rate parity, DABs, extending Kellogg, Rock Road, Compact 2000 with Sedgwick County, and REAP with communities in the area. Council Member Lambke Council Member Lambke said he appreciated Council Member Gale for his dedication and workmanship on all issues; Council Member Pisciotte for the fresh air brought to the City Council; and Mayor Knight, even though there were some disagreements in the past, Council Member Lambke said he had never seen anyone in government have more of the City's interests at heart. Council Member Fearey Council Member Fearey said it has been a privilege to serve with the outgoing members. It is a scary day for new people with so much to learn. Council Member Fearey thanked the outgoing Council members for their guidance, and offered her support for the newly elected Council Members and Mayor. Council Member Martz Council Member Martz said it was an honor to work with the outgoing members, and will be an honor to work with newly elected members and the Mayor. Council Member Martz said he looked forward to working for the betterment of the City. Council Member Brewer Council Member Brewer said he remembered what it was like two-years ago when he came on the Council - how confusing things were. The new Council will have time to get on-board. "As soon as this meeting is over with, you will get phone calls." Council Member Brewer stated that he treasured the friendship Council Members share. The City Council is like a family - tough to live with but "you cannot live without each other." He said he appreciated all of the support and would be in contact with outgoing Members on a regular basis. Mayor Knight Mayor Knight introduced his hero - his wife, Jane. This is the new Council Members and Mayor's day. It is a day of true excitement for the City. The people are assembled to wish the new Council well. Mayor Knight wished newly elected Mayor Mayans well and pledged his support. Mayor Knight said he will honor Mayor Mayans as the leader of the City. Carlos Mayans is capable, competent, and prepared to lead. Mayor Knight asked the community to set aside any differences and concern about the new City Council and asked them to give the Council the support it had earned, worked hard for, and prepared for. One thing about living in this City - as long as the Council and Mayor are tough, resilient, honest, bold, daring, and financial stewards, the citizens will "continue to pick you up and dust you off as long as you do not mislead them." The community always has its eye on the next generation. The community loves children and grand children. "I feel confident you will have tremendous support." The true passion is in the future - what tomorrow will bring. This is the most exciting time in human history to be alive. Mayor Knight wished all the new Council and incoming Mayor Mayans well. FILM PRESENTATION A film was presented showing a few of the outgoing Council Members and Mayor Knight's accomplishments. PRESENTATION Vice Mayor Martz made presentations to Council Members Gale and Pisciotte, and Mayor Knight. RESOLUTION HONORING OUTGOING COUNCIL MEMBERS AND MAYOR KNIGHT Motion -- Martz moved that a Resolution honoring outgoing Council Members and Mayor Knight be adopted. -- carried Motion carried 7 to 0. RESOLUTION A Resolution in honor of Council Members Gale and Pisciotte, and Mayor Knight, presented. Martz moved that the Resolution be adopted. Motion carried 7 to 0. RECESS The Council recessed briefly; Council Members Gale, Martz, and Pisciotte, and Mayor Knight left the bench. The City Council meeting reconvened with Council Member Fearey in the Chair. OATH OF OFFICE District Court Judge, Division 18, administered the Oaths of Office to Mayor Carlos Mayans, and Council Members Paul Gray, Bob Martz, and Sue Schlapp. Council Members Gray, Martz, and Sue on the bench; Mayor Mayans in the Chair. SELECTION OF VICE MAYOR The Council proceeded to vote and on the first ballot unanimously selected Council Member Fearey as Vice Mayor. OATH OF OFFICE District Court Judge, Division 18, administered the Oath of Office to Vice Mayor Fearey. COMMENTS FROM NEWLY ELECTED COUNCIL MEMBERS Mayor Mayans Mayor Mayans introduced his immediate and extended families, and thanked his good friends, the Honorable Judge Anthony Powell, and Father James J. Billinger. Mayor Mayans stated that in 1991, when asked about his role model for leadership in Wichita, he said "Bob Knight" who had a vision that he wanted to make Wichita a star in the prairie. Mayor Mayans and outgoing Mayor Knight have a lot in common - they sing alike. Council Member Pisciotte has been a lot of fun. He is a great guy with a great sense of humor, and a great professor. Many look to him for what he has contributed. Mayor Mayans thanked him for his service. Council Member Gale and his wife ate black beans and Cuban pork. They will continue to work together to bring cities in America together. Council Member Schlapp Council Member Schlapp said those who served before on the Council had done an awesome thing for the City. It is sad to see Mayor Knight leave. He will be remembered for what he has done. Outgoing Council Member Pisciotte put a "bug in my ear" and has been a good friend. Politics she got from her children, who learned it from Professor Pisciotte. Outgoing Council Member Gale is honest, moral, and has brought much to the City Council. All will be missed. All had hearts and minds for the City and came to the Council to serve. "I come not to be served - but to serve." Council Member Schlapp said she hoped she can be a little bit of the City's future and she looks forward to serving with all. Council Member Gray Council Member Gray thanked God and his wife, and said he hoped he could live up to the high-standards set for him. The previous Council Members and Mayor have done an outstanding job for the City. A year ago, Mayor Knight said "you are very young but I hope things work out for you." Council Member Pisciotte gave advice for running the campaign and how to serve. Council Member Gale overcame many of the same hurdles Council Member Gray is going through - Gale will be looked to for guidance. With the support of all, it is hoped the Council seat can be given the respect and service it deserves. Council Member Gray said he would try to carry on the good example set in the past. Council Member Martz Council Member Martz thanked his wife, father and mother-in-law. It is an honor to have a second opportunity to serve the City and District V. The outgoing members will be missed a lot. It has been an honor serving with them. Council Member Martz stated that he looked forward to seeing the outgoing members in the future - and now he can see two at-a-time and not violate any rules. Mayor Mayans Mayor Mayans said he looked forward to working with the City Council. City Staff and the City Manager are all very supportive and helpful. Staff is very competent. Mayor Mayans said he is living the American dream - a Cuban refugee who came to the United States. It speaks well of a community that embraces diversity and is willing to give this opportunity. "I feel very blessed to be the one given that opportunity." Mayor Mayans said he went to the campaign office almost daily and passed by the orphanage where it all started. "I look at it in disbelief that that little boy could become Mayor of the City of Wichita. I love you very, very much for the opportunity to serve." An attempt to award a construction contract within the budget set by the Petition was not successful. The developer has submitted a new Petition with an increased budget. The signature on the new Petition represents 100% of the improvement district. The project will serve a residential development located south of 53rd Street North, west of Hillside. The original Petition totaled $240,000. The new Petition totals $280,000. The funding source is special assessments. State Statutes provide that a Petition is valid if signed by a majority of resident property owners or owners of the majority of the property in the improvement district. Motion carried 7 to 0. STREET CLOSURES CONSIDERATION OF STREET CLOSURES/USES. There were no street closures submitted. SANITARY SEWER NORTHWEST SEWER IMPROVEMENTS - SUPPLEMENTAL. (District III) Agenda Report No. 03-0402 On January 19, 1999, the City Council approved a plan for a new sewage treatment plant and improvements to serve northwest Wichita. Professional Engineering Consultants (PEC) was selected on September 28, 1999, to perform the project management tasks which include development of plans, specifications, and project estimates for the construction phase. PEC will provide engineering services to redesign the Main 5 Project (a subproject of the Northwest Sewer). The redesign was requested by Public Works as a part of their plan review and value engineering. The change in the design concept is estimated to save approximately $600,000 in construction costs. This service were not included in the original Contract nor Supplemental Agreements. The original Contract was for $2,816,220. (District VI) Agenda Report No. 03-0403 An MOA between the Federal Highway Administration (FHWA) and the State Historic Preservation Officer (SHPO) is required to allow the expenditure of Federal Funds for the Central Rail Corridor. An MOA has been prepared by the FHWA that details the requirements to mitigate adverse effects on potentially historic properties within the Central Rail Corridor. Since the City of Wichita is a concurring party to this MOA, the City must sign the MOA prior to signing by SHPO and FHWA. The SHPO has made the following recommendations for documentation mitigation of the three historic properties (the UP/BNSF railroad bridge over 1st Street, the UP/BNSF railroad bridge over 2nd Street, and the Kansas Milling Company Flour Mill) because of the adverse effect declaration: a) Two copies of the original plans of the two railroad bridges should be made on acid-free paper (1-set for SHPO's archives and 1-set for the local historical society); and b) Two sets of large format photography (8x10 prints) should be taken of each of the three historic properties (1-set for SHPO's archives and 1-set for the local historical society). The photographs should provide an overview of each of the structures, with close-ups of their architectural detail, and interior photographs of the building showing interior design details and features. The required mitigation will be performed by the design consultant within the scope of their existing agreement. Baughman was asked to make some revisions after they had submitted the final plans. A Supplemental Agreement has been prepared for the additional engineering services. Payment will be on a lump sum basis of $5,595 and will be paid by special assessments. DATASTREAM HANDHELD DEVICES FOR DATASTREAM ASSET MANAGEMENT SYSTEM. Agenda Report No. 03-0405 On January 7, 2003, the Datastream project was approved by Council. The Datastream project provides full asset management capabilities for the entire City Fleet (including Fire, Public Works, Transit and Airport), Buildings (Public Works, Transit and Airport), and full enterprise management of Airport operations. The software and the initial set of handheld devices have been purchased for the project. An additional six handheld users have been identified within the Public Works department. This change order includes the cost of these additional devices, technical support and software licenses. Ongoing maintenance for these devices will be added to the department's budget during the budget season. There are funds available for the change order in the Fleet Maintenance budget, cost not to exceed $27,562.50. Agreements which exceed $10,000 require City Council approval. Agenda Report 03-0406 The City of Wichita was awarded a $200,000 grant from the United States Environmental Protection Agency, Brownfield Section. The grant is to fund environmental assessments of publically owned, or potential public development in areas considered "Brownfields". Brownfields are properties that are underutilized or undeveloped because they are perceived as having unknown environmental conditions or concerns. The Delano Area Environmental Assessment is the second project attempted under this grant. A contract was signed with TetraTech (May 14, 2002) for three tasks: an area wide survey of potential environmental problem properties within the Delano Site, an official Site-Wide Combined Phase 1 Investigation of those properties, and a generic Quality Assurance Program Plan (QAPP) which is required by the EPA prior to any soil or groundwater testing. However, the initial area survey and combined phase 1 report found more suspect properties than what was projected during the original contract negotiations which required more research and reporting. To that end, city staff have completed with Tetra Tech the first two tasks of the contract within the current contract amount and now wish to complete the QAPP report with the current contractor. This report must be approved by the granting authority, EPA, before work can start on the next phase of the project. The current contract was for a not to exceed sum of $88,565.00. To finish the last task of the current contract, the QAPP report, an additional sum of $4,586 is needed. This will bring the total contract sum amount to $93,150. WATER UPDATE WATER MASTER PLAN UPDATE. Agenda Report No. 03-0407 The City provides treated drinking water to 350,200 people. This population is projected to increase to over 438,000 by the year 2010. The service area includes the City limits, seven incorporated communities, an improvement district, three rural water districts, and a single community that receives wholesale untreated water. To ensure that future water needs are met, an objective evaluation of the Water Utility is conducted every five years. The most recent Water Master Plan Update was completed in 1998. The Water & Sewer Department uses master planning as a long-range planning tool for the improvement and expansion of its facilities. Master Plans help keep pace with growth, provide for additional development, and assure high quality service for customers. The Water Master Plan (CIP W-526) has a budget of $500,000. Agenda Report No. 03-0408 The Defense Authorization Act for FY 2002 authorized the Federal Emergency Management Agency (FEMA) to make $750 million in grants to fire departments. The programs and associated activities, eligible for this year's grant program are as follows: Fire Operations and Firefighter Safety program; Fire Prevention Program; Emergency Medical Services Program; and Firefighting Vehicle Acquisition Program. Applicants can apply for only one of the four programmatic areas, however within the selected programmatic area, applicants may apply for a number of activities. There will be no partial grant awards under the Program. The grant application, if approved, will be used to purchase 135 Motorola XTS 5000 Model III portable radios to replace current Motorola radios used by the Wichita Fire Department Operations personnel. The Fire Department also requests 35 less expensive Motorola MTX 8250 radios to be used by all other Wichita Fire Department staff. The Motorola Company stopped guaranteeing parts for current Fire Department portable radios in June 2000. These radios have been in service for the Wichita Fire Department for over eleven years. Over this time period, water has caused a great deal of damage to certain parts and repairs have become more and more frequent and lengthy. Until recently radio repair technicians have been able to scavenge parts from other radios to keep most of the STX model radios in service. However, because repair parts are no longer available, it is estimated that by the end of 2003 it will no longer be possible to provide repairs on this model of radio. Therefore, the Fire Department has an urgent need to replace existing portable radios. All of the new portable radios will be APCO 25 compliant as required by the new federal Department of Homeland Security. The total cost for radios and accessories would be $655,693. The City's match would be $196,708, leaving $458,985 to be funded through the Assistance to Firefighters Grant Program. Matching funds will come from savings within the Fire Department budget, or General Fund reserves. COMPUTER LABORATORY SOFTWARE AND HARDWARE. Agenda Report No. 03-0409 Water & Sewer and Information Technology Staffs evaluated database tracking needs associated with water/sewer analytical laboratories and the industrial wastewater pretreatment program. The current method of maintaining pretreatment data is obsolete and the computer hardware that supports the Laboratory Information Management System is out of warranty. Both the laboratory and pretreatment programs require database and hardware improvements in order to continue to operate effectively. Staff presented a business case detailing their needs to the IT/IS Advisory Board on March 19, 2003. The IT/IS Advisory Board approved the purchase of the hardware and software as proposed. Components of the proposal include: · Purchase LINKO Data Systems Pretreatment Compliance Tracking Software · Purchase upgrade of Laboratory Information Management System by PerkinElmer Instruments · Purchase Compaq Server, network components, and desktop computers · Purchase and install fiber optic cable in the Production & Pumping facility Failure to purchase the software and hardware recommended may result in failure to comply with the United States Environmental Protection Agency (USEPA) reporting and monitoring requirements, and inefficiencies in management of essential water quality information. The cost for software and hardware is $80,822. Funding is available in the approved 2003 Sewage Treatment budget in the amount of $45,000 and in the approved 2003 budget for Production and Pumping in the amount of $42,400. The purchase will be made according to Purchasing Ordinance 38-122(g), that relates specifically to high technology items. City Council approval is required for purchases over $10,000. The City received two acres of land in a trade with Unified School District 259. This land is to be used as park land and was formerly the location of Greiffenstein Elementary School. The Park Board met and approved a motion to have this new park named for a former member of the Park Board, Leon Robinson. Mr. Robinson served on the Park Board from June 1999 to August 2001 and died while in office. Mr. Robinson also retired from the City of Wichita after working for over 20 years. (District I) Agenda Report No. 03-0411 Part of the site for Metro-Boulevard High School was utilized for I-135 right-of-way when the highway was constructed in the 1970's. To replace parking that was lost in this transaction, the school district (USD 259) was to receive a tract immediately north of the school across George Washington Boulevard which had been acquired as part of the highway project but was surplus to the actual construction. A parking lot was constructed on this site and has been used and maintained by USD 259 since the early 1980's. No evidence of the actual transfer of ownership has been found. USD 259 intends to improve the Metro-Boulevard facility. To get building permits, they must show that they own sufficient parking. The parking lot is still titled in the City's name, it cannot be included to meet their parking requirements, thus preventing USD 259 from getting building permits. USD 259 has requested that the City deed the parking lot to them to complete the transaction as originally intended. ORDINANCE An Ordinance changing the zoning classifications or districts of certain lands located in the City of Wichita, Kansas, under the authority granted by the Wichita-Sedgwick County Unified Zoning Code, Section V-C, as adopted by City of Wichita Code Section 28.04.210. ZON2002-00064 AIRPORT AGENDA AIRPORT PROPERTY ACQUISITION - PORTION OF SOUTHWEST QUADRANT OF 45TH STREET NORTH AND GREENWICH ROAD FOR RUNWAY APPROACH PROTECTION AT JABARA AIRPORT. Agenda Report No. 03-0413 A portion of the quarter section lying in the southwest quadrant of 45th Street North and Greenwich Road lies within the runway protection zone and the runway approach protection zone for Jabara Airport. The total parcel encompasses 155.91 acres with 26.568 acres within the zone. The Airport Authority has requested that this tract be acquired to prevent further development in this protected area. It is zoned Rural Residential and is in agricultural use. The property was valued at $304,000. The owner has agreed to accept this amount. The property is currently undeveloped. When acquired, it will be seeded to grass to minimize its attractiveness to waterfowl. Funds have been budgeted in the Capital Improvement Program for acquisitions for runway protection. The FAA will ultimately provide 90% of the purchase price through their Airport Improvement Program. Interim funding source will be General Obligation Bonds paid for with airport revenue . A budget of $306,000 is requested. This includes $304,000 for the acquisition and $2,000 for closing costs and title insurance.
