Wichita Board of Appeals of Plumbers and Gas Fitters Minutes Wednesday, June 4th, 2008 Present: Terry Irwin, Keith Brewer, Andy Veatch, Jerry Short, Don Vaughn, Sr., and Leon Breedlove, David Lefler Absent: None Staff: Sharon Dickgrafe, w/ Law Department, Billie Vines w/ Water Department, David Laws w/ Central Inspection, Roger Young, w/ Central Inspection, Kurt Schroder, w/ Central Inspection and Kim Mudd, w/ Central Inspection Guests Present: Mike Dirck, Lonny Wright, Dan Leidy, w/PACK; Ray Frederick, Boy Howard, Kevin Lehane, Barbara Diss, Jay Martin, Jeff Caruthers w/ Cullingan Water Chairman, Terry Irwin called the meeting to order. Don Vaughn, seconded by David Lefler, moved to accept the May minutes with the corrections, motion carried 7 - 0. A lengthy discussion was held on the Water Conditioning Ordinance. Keith Brewer, seconded by Don Vaughn moved to table until the next meeting, motion carried 7 – 0. Mike Dirck made a few comments on the budget. Sharon Dickgrafe opened the hearing of Kevin Lehane with comments in regards to the options that would be available depending on the outcome of the proceedings. Boyd Howard, lawyer for Kevin Lehane, opened with comments. Mr. Howard discussed the cases that had been to court. Roger Young gave input on cases. Dan Leidy responded to some cases. At 10:30 a.m. a fifteen minute break was taken and the meeting resumed at 10:45 a.m.. Boyd Howard, Kevin Lehane and Barbara Diss had to leave for a previous engagement and would return to conclude the hearing. Joy Martin with Professional Engineering Consultants was present to present the Request for Variance for the project at Hawker Beechcraft Warehouse B89, located at 9709 E Central. The request was to adopt the “trap guard” by Pro Set Systems, for all floor drains. Ms. Martin had a sample of the “trap guard” and was reviewed by the board. David Lefler, seconded by Don Vaughn, moved to accept the “trap guard” for this request and future requests, motion carried 6 – 1. At this time Boyd Howard, Kevin Lehane and Barbara Diss had returned and the hearing resumed. Mr. Howard proceeded by going through each violation and discussion was held on each violation. Sharon Dickgrafe asked if American Sewer was still in operation. Kevin Lehane responded that American Sewer was disbanded. Ms. Dickgrafe wanted to know why he was still wearing the shirt with the company name on it. Sharon Dickgrafe asked if American Sewer was still able to continue depending on the outcome of these hearings. Kim Mudd stated that there was no current certificate of insurance on file, it had expired. Major discussion was held on being licensed and the violations. David Laws wanted to remind everyone that he thought we were missing the point why Mr. Lehane was brought before the board in regards to his certificate and license. Kurt Schroder stated he had spoke with Mr. Ed Quinn and he stated that he had no more association with Mr. Lehane on any current or past situations and American Sewer was shut done. Different options on suspension or revoking the individual certificates and the company license were discussed. Bill Vines made comments in regards to what he had observed during the hearing. Ray Frederick made comments, as a contractor stating the office of Central Inspection bends over backwards to work with contractors with corrections and/or violations. He also stated that after listening to the hearing that Mr. Lehane had plenty of opportunities to make corrections and work with Central Inspection. After more discussion, Andy Veatch, seconded by David Lefler moved to revoke the American Sewer license and to demote Mr. Lehane’s Master certificate down to the Journeyman level, and Mr. Lehane had the option to file an appeal and ask to be reinstated, motion carried 7 – 0. Due to the length of the meeting, it was decided to move the Viega gas fittings to the July meeting. Don Vaughn, seconded by David Lefler, moved to adjourn the meeting, motion carried 7 – 0.
