Council Members Gale, Lambke, Martz, Pisciotte, Rogers; present. *Council Member Cole absent. Chris Cherches, City Manager; Gary Rebenstorf, Director of Law; Pat Burnett, City Clerk; present. The invocation was given by Rabbi Pincus Aloof, Ahavath Achim Hebrew Congregation Traditional. The pledge of allegiance to the flag was participated in by the Council Members, staff, and guests. Minutes -- approved The minutes of the regular meeting of March 21, 2000, were approved 6 to 0. (Cole absent) AWARDS AND PRESENTATIONS PROCLAMATIONS Proclamations previously approved were presented. PUBLIC AGENDA Ben Mitchell, Kansas Vietnam Veterans and Family Reunion -Acquisition of West Bank Stage. Ben Mitchell Ben Mitchell said the Kansas Vietnam Veterans and Family Reunion was interested in acquisition of the West Bank Stage which would be moved to and used at the Eldorado Lake. Mayor Knight Mayor Knight said Staff had indicated a possible future use for the stage; however, if that were not the case he would be in favor of the Mr. Mitchell's request. Mayor Knight asked that Mr. Mitchell meet with the City Manager. UNFINISHED BUSINESS LIQUOR TAX SPECIAL LIQUOR TAX FUNDS ADMINISTRATION. Continued from March 21, 2000. Council Member Pisciotte reviewed the Item. Agenda Report No. 00-0212. Since 1997, the City has been reviewing the Special Liquor Tax allocations that fund alcohol and substance abuse providers. As part of this review process, a consultant was hired to work with providers to develop outcome-based measurements and to evaluate achievement and performance. The final work product of the consultant was reviewed by the City Council on December 14, 1999. The City Council, in December, 1999, approved funding levels for providers based upon performance; authorized funding for pilot programs; approved a change in governance to eliminate the current advisory board and to replace it with a coalition to address alcohol and substance abuse issues; and approved contracting program administration. In response to the City Council’s authorization to privatize administration of the Special Liquor Tax Program, the City solicited Request for Proposals (RFP) for program administration. Four proposals were received for this service. The RFP outlined the required tasks associated with program administration. Proposers were requested to: (1) Monitor and refine the outcome-based measurements developed by the providers; (2) Provide financial management by reviewing/approving invoices for service: (3) Address changes in governance by working in partnership with Sedgwick County COMCARE to develop a coalition for governance of the Special Liquor Tax program. In addition, the contractor will be required to provide staff to the coalition and to make appropriate programmatic and funding recommendations based upon the work of the coalition. The scope of work included in the contract will involve the development and oversight of pilot programs, including the ability to write the RFPs and participate in the selection process. Finally, the contractor will provide a final report with recommendations on funding and to communicate findings and recommendations to the City Council. The City utilized a Selection Committee comprised of representatives from the private sector, Wichita State University, and City government. The Committee reviewed four proposals and conducted interviews. One of the proposals was rejected by the Committee because of a conflict of interest (City currently funds two of its programs). Additionally, the Committee did not feel the other proposals demonstrated the quality of staffing, management skills, program familiarity and outcome-based measurement experience as the recommended contractor. The adopted Year 2000 Budget provided program funds for administration of the Special Liquor Tax fund. Council Member Pisciotte Council Member Pisciotte explained that at the time the vendors were reviewed, COMCARE had a potential conflict of interest; however, COMCARE has agreed to forego receipt of funds for administration of the contract.. COMCARE is on par with Public Solutions and COMCARE is the recommended contractor. Mayor Knight Mayor Knight inquired whether anyone wished to be heard and no one appeared. (Cole absent) PAVING ASSESSMENTS PROPOSED ASSESSMENTS - CONSTRUCTION OF DECEL LANE ON MAIZE ROAD TO SERVE CHADSWORTH SECOND ADDITION: PROJECT NO. 472-82191. (District IV) Continued from March 21, 2000. Mike Lindebak City Engineer reviewed the Item. (490-436/763334/472-82191) - Construction of a decel lane on Maize Road to serve Chadsworth Second Addition - north of 21st, east of Maize, as authorized by Resolution No. R-92-035, adopted January 28, 1992, and published January 31, 1992. Petition for this improvement was signed by owners representing 100 percent of the property ownership. The Statement of Cost approved December 14, 1999 in the amount of $21,919.00 is to be apportioned 100 percent payable by the improvement district and none to the City-at-Large. The cost has been assessed on a fractional basis. Mike Lindebak City Engineer explained that a previous assessment for a decel lane on 21st had been made. NEW BUSINESS Mayor Knight momentarily absent with Vice Mayor Rogers in the Chair. DAB ADM. POLICY DISTRICT ADVISORY BOARD ADMINISTRATIVE POLICY. Chris Cherches City Manager reviewed the Item. Agenda Report No. 00-0301. On December 14, 1999, the City Council approved the District Advisory Board structure for the citizen involvement process. The District Advisory Boards primary objective is to provide the City Council and District City Council Members advice and recommendations on matters of public policy, citizen engagement and on problems/issues specific to the District. District Advisory Boards will review and advise the District Council Members on policy issues, planning/zoning cases, traffic items and other issues impacting the District. The City Council requested that administrative policies and procedures be developed as guidelines for the District Advisory Boards. At its March Retreat, the City Council reviewed the Polices and Planning Process, suggested certain revisions and directed that the Council move forward with the adoption and implementation of these policies and procedures for the governance of the District Advisory Boards. District Advisory Board members have been appointed by the City Council and initial meetings of the Board have been conducted. The proposed Administrative Policies and Process for Receiving and Handling Planning/Zoning cases provide uniformed guidelines for the District Advisory Board operations. The Administrative Policies provide bylaws and guidelines for the following such areas as Membership and Terms, Meeting Procedures, Quorum and Voting, Agenda format, Conflict of Interest provisions, and related matters pertaining to the functioning of the Boards. The Process for Receiving and Handling Planning/Zoning cases include the process for the Boards to deal with Case Reviews, Notices, and the Review and Meetings process. Motion -- Knight moved that the Administrative Policies/Bylaws be approved with the "Meetings and Procedures," Section (5), meeting days changed from "Mondays" to "first and third weeks" (allowing each district to select specific meeting days); and the Process for Receiving and Handling Planning and Zoning Cases, be approved with the "Meetings to Hear Cases," Section (6), changed from "third Monday" to "third-week meeting." Motion carried -- carried 7 to 0. CORR. HOUSING ALTERNATIVE CORRECTIONAL HOUSING ORDINANCE. Council Member Cole reviewed the Item. Agenda Report No. 00-0302. The Alternative Correctional Housing Advisory Board, currently chaired by Council Member Joan Cole, oversees the regulation and licensing of Alternative Correctional Housing facilities in both the City of Wichita and Sedgwick County. This Board, along with the Alternative Correctional Housing Regulatory Board has been in existence for almost four years. During this time, the need for changes to the minimum licensing standards for Alternative Correctional facilities has become apparent. Accordingly, a subcommittee of the ACH Advisory Board has prepared an enhanced set of minimum standards for Alternative Correctional facilities, which are reflected in the proposed amendment. Input from Alternative Correctional facility providers was sought, and the standards were voted on and approved by both the ACH Advisory and Regulatory Boards. The proposed amendments to Section 20.08.110 of the City Code provide a more detailed set of minimum standards to guide Alternative Correctional Housing providers in their day-to-day operation of such facilities. The ultimate goal of the enhanced standards is to elevate the quality of the correctional aspect of these facilities so that they better address the needs of the residents, while also imposing requirements on these same facilities that address the concerns of the community regarding public safety. Particularly notable among the proposed amendments are provisions setting forth specific minimum requirements for written policies on fire prevention, personnel matters, discipline of residents, emergency procedures, grievances by residents, reimbursement of the facility by residents, case management, programs, medical services and transportation. The proposed changes have also been prepared with the ACH auditors in mind, by providing more definite parameters within which the auditors will evaluate individual facilities for licensing purposes. The proposed amendment also includes a change to Section 20.08.040 of the City Code, which currently requires that the ACH Regulatory Board establish regular monthly meetings. The proposed amendment changes the ordinance to require that the Regulatory Board establish bimonthly meetings instead, due to the fact that there has not been enough business coming before the Board to justify monthly meetings. If in the future more frequent meetings become necessary, the ordinance allows for scheduling additional meetings of the Regulatory Board. Council Member Rogers momentarily absent. ORDINANCE An Ordinance amending Sections 20.08.040 and 20.08.110 of the Code of the City of Wichita, Kansas, pertaining to scheduled meetings of the Alternative Correctional Housing Regulatory Board and minimum standards for correctional placement facilities, and repealing the originals of said Sections, introduced and under the rules laid over. (District IV) Dondlinger & Sons Construction Co., Inc. has contracted to replace the 55th Street South Bridge over the Big Slough (between Broadway and Hydraulic). The Contract allowed for the Contractor to request Closure of 55th Street South. It also allowed the Contractor to remove and replace the existing structure with a new bridge with capacity for four lanes to accommodate the future widening of 55th Street South. Right-of-way constraints and safety concerns make it impractical to carry traffic through the work zone. The Contractor is requesting that 55th Street South be closed at this location from March 29, 2000, through September 1, 2000. The Contractor is responsible for the construction barricades and detour signing. Affected citizens have been notified of the proposed closure. A March 23, 2000 Neighborhood Meeting was held to explain the project. During the Closure, 55th Street South would be detoured using 47th and 63rd Streets. The Weed and Seed Program is a federally-funded grant program that brings together Federal, state, and local law enforcement agencies; social service providers; representatives of the public and private sectors; prosecutors; business owners; and neighborhood residents to "weed" out violent crime and gang activity, while "seeding" the community with social services and economic revitalization. The Weed and Seed Program is administered in "officially recognized" sites. Wichita's officially recognized site has been selected for fifth-year site status eligibility. It is in the geographic area bounded by Central, I-135, 29th Street North, and Hillside. For Federal fiscal year 2000, the funding for the "weeding" component of the Weed and Seed Program is from Federal Asset Forfeiture funds through a Cost Reimbursement Agreement between the City and the Drug Enforcement Administration. The Cost Reimbursement Agreement is for $50,000 to pay for overtime and fringe benefits, training, law enforcement supplies, equipment and vehicle rental costs. The document FY 2000 Request for Asset Forfeiture Funds details the City's weeding strategy and use of funds. The Cost Reimbursement Agreement with the Drug Enforcement Administration will reimburse the City for up to $50,000 to pay for overtime and fringe benefits, training, law enforcement supplies, equipment and vehicle rental costs. The proposed school (Mall Academy) is a collaborative effort between Communities in Schools, USD 259 and the Simon Youth Foundation (affiliated with Simon Properties-Town East and Town West). This collaboration stems from a national collaboration between the national Communities in Schools and the Simon Foundation and is designed to address the needs of high school dropouts by providing the means to earn a high school diploma and work skills. The City is being requested to assist in the implementation of this new program with a one-time contribution. The program will establish a Town East Square Education Resource Center (ERC). The Simon Youth Foundation will provide 3,800 SF of space to USD #259 and will design, build and lease the space at no cost to the School District. The initial program will target 100 dropouts and offer the opportunity to earn a high school diploma while simultaneously acquiring necessary life and work related skills. The model combines two national award winning programs of demonstrated effectiveness: (1) the technology-based EXTRA Program that provides the tools for self- paced academic and life skills learning and the Performance TRAC (Training Retail and Commerce Program) which provides technology-based, retail skills component; and (3) a highly structured work-based learning that emphasizes core transferable skills needed in any career. The Academy will be staffed by certificated teachers in a variety of areas, paraprofessionals, CIS Specialist and an Academy Coordinator. The total project cost is projected to be $656,835. The Simon Youth Foundation has committed $250,000 for the space renovation and free rent for three years. The Wichita Public Schools is expected to provide $200,000 in start- up costs and provide on-going state aid of $3,800 per pupil. The City is being requested to provide $50,000 to assist with start-up costs, including the purchase of equipment, furniture and staff. If approved, funding could be allocated from the January, 2000, Quarters At Cambridge contribution as a one-time allocation. [A contribution of $100,000 was made available from a contribution from the Quarters At Cambridge, L.P. for use in a public improvement project to be designated by the City Council. A portion of these funds were to be targeted to improvements at the N/E Baseball Complex.] In the opinion of the Law Department, the contribution to Communities in Schools of Wichita/Sedgwick County, Inc., in the amount, from the sources and for the purposes contemplated is an appropriate expenditure in advancement of the public purposes of local economic development and public education. (Item No. 24) FOODBANK KANSAS FOODBANK WAREHOUSE FUNDING REQUEST. Agenda Report No. 00-0318. The Kansas Foodbank Warehouse has been in operation since 1983. It provides food to non-profit agencies for distribution to the ill, the needy and infants . Currently, the Kansas Foodbank Warehouse operates with 10 full-time and 3 part-time paid staff and 30 volunteers per day. The Kansas Foodbank Warehouse provides food to over 400 agencies in 85 Kansas counties responsible for feeding over 100,000 people per month. In Sedgwick County, the Kansas Foodbank Warehouse supplies food to 216 agencies serving 49,000 persons per month. Due to the growth of the program over the last seventeen years, the agency has exhausted its existing storage and freezer space at the current location (806 East Boston). The Kansas Foodbank Warehouse has selected a downtown location to build a new warehouse and distribution center. The new warehouse and distribution center will relieve stress on facilities and increase the efficiencies of operations by consolidating all functions in one location. This will eliminate the on-going expense for temporary storage and freezer space. The new facility will permit the Kansas Foodbank Warehouse to be more responsive and cost effective and react quickly to emergency situations such as last year’s tornadoes and flooding. The Kansas Foodbank Warehouse is requesting a grant of $150,000 from the City to assist with the acquisition and improvement of property. Funding assistance, if approved by the City Council, will be made available from unexpended (prior year) CDBG funds. CDBG regulations require a 30-day public comment period as a Substantial Amendment to the Consolidated Plan before funds can be used for acquisition. Use of CDBG funds requires compliance with the Uniform Relocation Act. Lionel Alford Lionel Alford said help is needed to build a new facility which will add value to the community. At present, trailers and refrigerated facilities are being rented. ANNEX WITHDRAWAL HAYSVILLE PUBLIC SCHOOLS - WITHDRAWAL OF ANNEXATION REQUEST. Agenda Report No. 00-0319. In 1997, Haysville Public Schools petitioned the City of Wichita for water service to be provided to Campus High School. As a result of that petition, Wichita subsequently initiated annexation of the Campus tract. The City of Haysville opposed the annexation and indicated that Haysville desired to island annexation the school tract. On March 3, 2000, Wichita received a request from the Haysville Schools superintendent to withdraw their petition, at the request of Haysville, for annexation. Staff has met with personnel from the City of Haysville and Haysville Public Schools and reached agreement on the following issues which staff recommends form the basis for the Council’s release of Haysville Public Schools from its petition. ? The City of Haysville will not impose any franchise fees or taxes upon the City of Wichita for continuing to provide water and sewer service to serve Campus High School and the new elementary school located on the Campus tract. Haysville Public Schools will continue to pay the established water rate for customers outside of the Wichita corporate limits. ? In the event that the City of Wichita annexes portions of Meridian and 55th Streets -- which are adjacent to the Campus tract -- and there becomes a need for road improvements to be made, the cities of Haysville and Wichita will share in the cost of these improvements. If a traffic study indicates that additional improvements (turn lanes, accel/decel lanes, signalization, etc.) are necessary to specifically serve the Campus tract, Haysville Public Schools will fund the portions of the project that directly benefit the school(s) on the site. ? In the future, if the Campus High School tract (including Campus High School and the adjacent Haysville elementary school) is no longer used by Haysville Public Schools as an education facility, Haysville will de-annex the site and allow the City of Wichita to annex it into its corporate limits. There are no fiscal impacts regarding the non-annexation of the Campus tract. Being tax exempt, the school district pays no ad valorem taxes. The school district will continue to pay the established water and sewer rates for customers outside of the Wichita corporate limits. HUD BUDGET 2000 HUD BUDGET AND PERFORMANCE FUNDING SYSTEM (PFS). Agenda Report No. 00-0321. The Wichita Housing Authority (WHA) and the Department of HUD have a mutual responsibility for the financial stability of the Public Housing Program. The annual budgetary process is the principal focal point of cooperative effort to plan the exchange of information and reconciliation of judgment. The purpose of the budget, as a financial summary and analysis of immediate and long-range operating programs and plans, is to provide the WHA with an effective instrument to control operations and achieve operating objectives in a balanced and businesslike manner. Pursuant to Section 9(a) of the U.S. Housing Act of 1937, the Department of HUD implemented the Performance Funding System (PFS) for determining the amount of operating subsidy to be paid to most Public Housing Authorities (PHA). The PFS serves two primary purposes. First, it is used to determine each PHA’s share of the total operating subsidy funds appropriated by Congress each fiscal year. Second, it provides a reliable means of estimating the annual aggregate operating subsidy eligibility of PHAs which serves as the basis for requesting annual appropriations from Congress. The 2000 HUD Operating Budget and PFS Operating Subsidy were adopted by the Housing Board on March 16, 2000. The total budgeted expenditure of the Operating Budget is $2,229,455. This amount represents a 3.4% increase over the 1999 budget. The PFS operating subsidy budget is based on the total budget, less projected revenues. The final budget may be amended by HUD based on its line item budget reviews. The submission of the Operating Budget and PFS are the essential components that enable the WHA to receive the funding necessary for the operation of the Public Housing Program. HUD CPO AMENDMENT TO HUD CITIZEN PARTICIPATION PLAN. Agenda Report No. 00-0322. HUD requirements for the Consolidated Plan require the City to identify how the City will provide for citizen participation as a part of the Consolidated Plan process. A written citizen involvement plan is to be incorporated into the Consolidated Plan and be available for public review. On December 14, 1999, the City Council took action to replace the Citizen Participation Organization with District Advisory Boards for each Council district. In addition, as part of the restructuring of the citizen advisory board/commission process, the City Council abolished the Human Services Advisory Board in favor of community coalitions and more involvement of the District Advisory Boards. These changes necessitate revisions to the Consolidated Plan. The amended HUD Citizen Participation Plan includes replacing the Citizen Participation Organization and Human Services Board with six (6) District Advisory Boards (one for each City Council district). It also changes the composition of the City’s 12-member Grants Review Committee (from four Citizen Participation Organization members and one Human Services Board member) to four District Advisory Board representatives. The other Grants Review Committee membership will stay the same and include representatives from: Sedgwick County, Wichita State University, United Way, Wichita School District, Wichita Independent Neighborhood Association, and representatives from large and small businesses. The proposed changes were published in accordance with HUD regulations requiring a thirty-day public comment period. The comment period expired March 9, 2000 and no comments were received. The amendment has no financial impact. The amendment to the Citizen Participation Plan is required to make the City’s HUD Consolidated Plan conform to actions previously approved by the City Council. Motion --carried Knight moved that the amendment be approved. Motion carried 7 to 0. PARK PROGRAMMING ADULT AND YOUTH ATHLETICS PROGRAMMING – DEPARTMENT OF PARK AND RECREATION. Agenda Report No. 00-0323. As part of the 2000 Adopted Budget, the City Council approved $50,000 in contingency funding for new youth and adult athletics programming at City athletic facilities. The funding was based on projected increases in new league and tournament activity, with specific allocations to be determined following development and presentation of an in-depth proposal for use of the funds. Recreation staff has developed a detailed proposal for youth and adult athletics programming. This proposal includes expansion of the youth softball program to include two new divisions; the addition of a new age grouping to youth baseball programming; a new youth baseball tournament at Lawrence-Dumont Stadium; and a planned 10% growth in youth football. In addition, the proposal includes programming for a Labor Day soccer tournament at the South Lakes Park complex, in cooperation with the Sedgwick County Soccer Association. Adult athletics programming enhancements include the addition of a new softball league and ten softball tournaments, all at South Lakes Park. Expenditure approval in the amount of $37,820 is necessary for implementation of the identified youth athletics programming initiatives. New programs are expected to generate $30,500 in revenues (81% cost recovery). Adult athletics enhancements at South Lakes are projected to return $25,310, based on a $24,390 investment in programming (104% cost recovery). Existing contingency funds in the amount of $50,000 are available in the Recreation Division budget. These funds will provide over 80% of the monies needed to implement proposed programming. The vendor will be selling food and non- alcoholic beverages approved by Department of Park and Recreation staff, and have agreed to return twenty-five percent of gross sales to the City. In February, 2000, the Department of Park and Recreation issued a Request for Proposal to qualified vendors, soliciting proposals to provide concession services at the South Lakes Sports Complex for the year 2000. Vendors were required to prove their ability to sell food prepared on site, as well as both non-alcoholic beverages and cereal malt beverages. Only one vendor, R&B Concessions, responded to the Request for Proposal; however, this vendor did not propose selling cereal malt beverages. Consequently, this requirement was removed from the contract, and the proposal as submitted by R&B Concessions was approved by the Department of Park and Recreation. The vendor agrees to return to the City of Wichita twenty-five percent of the gross receipts from the sale of food and beverages at South Lakes Sports Complex softball field location. On October 20, 1998, the City Council approved the construction of a force main, sewer pump stations and extension of gravity-flow sewer lines to serve northeast Wichita. A tract of land has been acquired for a pump station near Kellogg and Greenwich. Utility easements for the facility, access and temporary construction easements will be across property owned by Universal Motor Fuels, Inc. The permanent utility easement encompasses 5,700 square feet. The temporary construction easement will impact 15,800 square feet. The City will have a non-specific right of access across the property to the west side where the entrance to the pump station is located. The property owner has agreed to grant the easements and allow access to the City for $36,825. A budget of $38,000 is requested. In October of 1998, staff was instructed to pursue opportunity purchases in the Kellogg corridor. Opportunity purchases arise when an owner contacts the City and indicates a willingness to sell their property. The owners of 70 Mission, William and Barbara Provine, have expressed an interest in selling this property to the City. The site contains 18,700 square feet and is improved with a 3,044 square foot brick, ranch-style single family residence. The property has four bedrooms and four and a half baths. The planned expansion of Kellogg will require the removal of the improvements and utilization of the entire site. The property was appraised at $190,000. The owner has located a acceptable replacement dwelling that is currently available for $220,000 and has agreed to accept this amount for the property at 70 Mission. Early acquisition will avoid future relocation and moving expenses. The property appears to be in good condition with no deferred maintenance noted. From 1995 through 1998, the City of Wichita issued several series of industrial revenue bonds to assist in financing certain facilities for the benefit of Rand Graphics, Inc. (“Rand”). The City holds an interest in a portion of the property, located on Hoover Road, pursuant to a Site Lease executed by Ralph Vautravers (Chief Executive Officer of Rand) and assigned to the City. The City leases its interest back to Rand under the IRB Lease (as amended and supplemented through 1998). The form of the Lease document includes unusually restrictive Issuer covenants by which the City pledged not to permit any encumbrances other than “Permitted Encumbrances,” as defined in the Lease. The definition of “Permitted Encumbrances” did not include telephone utility easements. Ralph Vautravers and Rand seek the City’s consent to creation of a utility easement on a portion of the project property, in favor of Southwestern Bell Telephone Company. A 00-04 A 00-04 - BOX DEVELOPMENT, LLC, REQUESTS THE ANNEXATION OF PROPERTY GENERALLY LOCATED AT THE SOUTHWEST CORNER OF 37TH STREET NORTH AND RIDGE ROAD, TO THE CITY OF WICHITA, KANSAS. (District V) Agenda Report No. 00-0335. The City has received a request to annex a 17.2 acre area situated at the SW corner of 37th Street North and Ridge Road. The easterly boundary of the site abuts the current City limits. The property owner is planning to develop the property with commercial and retail uses, with the staging of development occurring over a two to three year period beginning this year. The Metropolitan Planning Commission approved the final plat of the proposed development on January 13, 2000. The requested annexation area falls within a larger area that is being considered for unilateral annexation. Land Use and Zoning: The annexation site consists of one tract of undeveloped tract of land, zoned “LC” Limited Commercial and “SF-20” Single Family Residential, that will be subdivided into eight (8) separate lots (DP-242 “Ridge Center” C.U.P.). Land to the north, northeast, south and southwest of the site is zoned “SF-20” Single Family Residential with “LC” Limited Commercial at the corners of the intersection of 37th Street N and Ridge Road. Land to the east of the site is zoned “SF-6” Single Family Residential (except for that part zoned “LC” Limited Commercial at the corner of the intersection of 37th Street N and Ridge Road). The proposed zoning for the annexation area is “LC” Limited Commercial and “NR” Neighborhood Retail. The City Water and Sewer Department indicates that the subject property will have access to a 20 inch water main that is currently being installed along the Ridge Road right-of-way, between 29th Street North and 37th Street North. As for sewer, the property proposed for annexation will have access to City sewer via a 10 inch line along the Ridge Road right-of-way, between 29th Street North and 37th Street North, that is also presently under construction. Street System: Once all stages of the development have been completed, the property proposed for annexation will have access to 37th Street North, a two-lane unimproved section line road, which serves the area as the nearest major east-west road. The site will also have access to Ridge Road, a four-lane improved section line road, which serves the area as the nearest major north-south road. Currently, there are no plans to further improve that portion of Ridge Road or that portion of 37th Street North in the City of Wichita 2000-2009 C.I.P. or the 2000-2004 Sedgwick County C.I.P. Public Safety: The Wichita Fire Department can serve this site within an eight (8) to nine (9) minute approximate response time from City Station #16 located at 1632 N. Tyler Road. Parks: Sedgwick County Park, a 480 acre regional park, is located approximately two (2) miles south of the property proposed for annexation. The park may be accessed through entrances located off 21st Street North. The Wichita-Sedgwick County Parks and Open Space Master Plan: Parks and Pathways indicates no plans for future parks near the area proposed for annexation. School District: The property is located in Unified School District 266 (Maize School District). Annexation will not change the school district. Urban Growth Area & Policy 32: The property is located outside of the urban growth area of the City of Wichita as shown in the 1996 amended Wichita-Sedgwick County Comprehensive Plan. Although the property is located outside of the current Policy 32 urban service area, the property is located within the 2010 urban service area, as proposed in the draft 1999 update to the Comprehensive Plan. The property proposed for annexation is currently vacant. The future assessed value of this property will depend on the timing of development, the type of development and the current mill levy. (District II) Marvin Krout Director of Planning reviewed the Item. Agenda Report No. 00-0303. On January 25, 2000, the City Council adopted a resolution that established March 28, 2000, at 7:00 p.m. at the East Point Church of Christ, 747 E. 127th Street East, Wichita, Kansas as the date, time and place for a public hearing for this annexation. The properties proposed for annexation are located ½ mile south of Kellogg and east and west of 143rd Street East. Originally, the annexation of several subdivisions on the east side of Wichita (A 99-19) was to occur in one phase. However, due to typographical errors found in the legal descriptions, discovered after the publication of the ordinance (December 24, 1999), certain subdivisions were rendered ineligible. Although 753 acres and approximately 587 homes were brought into the City effective December 24, 1999, the errors have necessitated second and third phases of annexation and subsequent adjustments to the Service Extension Plan. The subject area of the second phase consists of approximately 267 acres and 397 properties (all are platted). The land-use pattern is primarily residential with several undeveloped tracts scattered throughout the area. The majority of the area is zoned “SF-6” Single Family Residential and "SF-20" Single-Family Residential, with some small areas at the intersection of 143rd Street East and Harry zoned “LC” Limited Commercial. Those areas zoned “SF- 20" will convert to the "SF-6" Single-Family Residential district (or “SF-10” Single-Family Residential district if requested by the property owner) upon annexation while other properties will retain their existing zoning. An informational meeting was not held regarding the proposed annexation as the information meeting held on November 9, 1999 at the East Point Church of Christ, 747 E. 127th Street East included this area. Several property owners attended the meeting and asked numerous questions regarding the proposed annexation. In accordance with Kansas statutes, a Service Extension Plan was prepared for this unilateral annexation. The Plan describes the means by which City services will be extended to the area. Map No. 2 in the Plan shows the properties proposed for annexation, while Map No. 6a shows those properties which have signed and/or recorded “Outside of the City Water/Annexation” agreements. The analysis of the proposed annexation is contained in the plan. The total appraised value of the land and improvements of this annexation is $52,005,782, with a resulting initial annual City Ad Valorem tax revenue of approximately $182,720. Major municipal services to be provided to this area upon annexation are street maintenance, ditch cleaning, culvert cleaning, fire protection, police protection, building code enforcement, and health code enforcement. The operating departments currently delivering these services will fund them upon annexation. Major municipal services, such as local street improvements, water and sewer service, may be provided to this area upon request of the property owners. The cost of municipal services requested by the property owners will be distributed among the City at large and the benefiting property owners according to current City policies. The Service Extension Plan has been on file for public inspection in the Office of the City Clerk. Copies of the resolution establishing the public hearing, a map (showing the properties included) and a notice of the public hearing, were sent by certified mail to all property owners of record in the proposed annexation area and to other established governmental entities and utility services. Copies of the resolution and map have also been published in the official City newspaper as further notification of the scheduled public hearing. The Metropolitan Area Planning Commission reviewed the proposed annexation for compatibility with the Comprehensive Plan on February 24, 2000. The staff report presented at the MAPC meeting indicated that the proposed annexation was in conformance with the Comprehensive Plan. The MAPC found the proposed annexation in conformance with the Comprehensive Plan by a unanimous vote (11-0). In conducting the public hearing, Kansas statutes require that the City’s plan for extending major municipal services be presented and that all persons interested in the annexation be heard. After hearing all comments of the persons interested, the City Council has the option of continuing or closing the public hearing, and approving or rejecting the annexation proposal. Mayor Knight Mayor Knight inquired whether anyone wished to be heard. Phoebe Bush Phoebe Bush, 1450 Lookout Drive, inquired as to why Springdale and Crestview areas were not being annexed. Ms. Bush also inquired whether there would be a reduction in county taxes. Marvin Krout Director of Planning explained that Springdale and Crestview, as improvement districts, are not eligible at the present, under State law, for annexation. The City of Wichita is interested and will eventually pursue annexing these areas. Council Member Pisciotte Council Member Pisciotte said the City of Wichita will do whatever is possible to annex the Springdale and Crestview areas. Motion -- Knight moved that the Declaration of Emergency be approved and the Mayor be authorized to sign; the Public Hearing be closed; the annexation request be approved and the Ordinance be adopted on first reading.
