Today the City Attorney for the City of Wichita filed a lawsuit in state district court against the owner of the residential property located at 2718 East Tenth Street, seeking an injunction prohibiting the property owner from maintaining a common nuisance at the location.
The lawsuit also asks for an order to allow the City of Wichita to abate the common nuisance by removing the tall grass, weeds, junk and debris, all at the cost of the property owner. The debris includes a refrigerator, exercise equipment, wood pallets, tables, rotten hay, broken fencing, broken chairs and milk crates.
The house was not visible due to junk and overgrowth of trees. The lawsuit alleges that the citizens of the City of Wichita will suffer irreparable harm if the property is allowed to remain a common nuisance and the illegal activities are allowed to continue.
City Attorney Gary Rebenstorf said the case will be “pursued vigorously to eliminate the nuisance condition of the property.”
