The City of Wichita settled pending litigation today over 69 pit bulls seized this summer as part of a state court search warrant.
Timothy Collins, the pit bulls’ owner, agreed to let the City of Wichita euthanize the remaining 51 dogs.
The City sought the district court’s direction on disposition of the pit bulls in a hearing November 17, 2006. The court then did not address financial responsibility for the care of the animals while in custody of the City of Wichita.
Collins did not appeal the decision to the Kansas Court of Appeals. If he had done so, the City would have requested he post a bond equal to the care expenses during the pending appeal. Both parties agreed to waive these rights to expedite a resolution of the animals.
Collins has also agreed to reimburse the City of Wichita the sum of the veterinary costs ($4,071.00) for his dogs while in City custody. He is scheduled to pay the obligation by Dec. 7,
2007.
Collins authorized the City to immediately euthanize all his dogs in the custody of the Animal Shelter. Collins released the City from liability for the search, seizure, care and euthanasia actions, which begin this evening. The City released Collins from liability for the costs of boarding the pit bulls destroyed.
