The City of Wichita's policy is to respect and protect the privacy of our citizens and business partners. Wichita Transit is an operating department of the City of Wichita and strives to uphold this policy.
- You can use the Wichita Transit system anonymously and do not have to provide us with personal information.
- As a Governmental Entity in Kansas, the Kansas Open Records Act (KSA 45-223, commonly known as KORA) governs the use and the release of the information that you provide to Wichita Transit.
- When you use Wichita Transit's website (www.WichitaTransit.org), RIDE WICHITA or myStop applications, smart card services or other trip booking tools, we collect and store data about the use of that web site, app, or card, including what rides are taken and location data.
- We do not (and will not) sell your personal information to any third parties for any reason,including advertising.
- We collect data on how people use the website and apps to better understand the user experience and identify ways to make it better. The data we collect helps us understand how and where people use our services and to provide support to our customers.
- If you choose to register, we take steps to protect the personal data you provide in secure systems that live in a controlled facility.
Information Collected and Stored Automatically
If all you do during your visit is browse through the website, read pages, or download information, we will gather and store certain information about your visit automatically. This information does not identify you personally. Only the following information is automatically collected and stored about your visit:
- The Internet domain (for example, "thiscompany.com" if you use a private Internet access account, or "thatschool.edu" if you connect from a university's domain) and IP address (an IP address is a number that is automatically assigned to your computer whenever you are surfing the Web) from which you access our website.
- The type of browser and operating system used to access our site.
- The date and time you access our site.
- The pages you visit.
- If you linked to our website from another website, the address of that website.
We use this information and statistical analysis to help us:
- Make the site more useful to visitors.
- To better design services and facilitate access to services.
- To learn about the number of visitors to our site and the types of technology our visitors use.
We do not track or record information about individuals and their visits. No marketing databases are created nor is any commercial use made of any such data. This site does not contact you without your explicit permission.
Types of Data and Information:
Personal Identifying Information (PII)
Personal Identifying Information (PII) identifies or describes a person or can be directly linked to a specific individual. Examples of PII include, but are not limited to, a person's name, mailing address, billing address, business name, alternate contact information (if given), telephone number, email address, fax number, Wichita Transit card number, credit or debit card number, security code and expiration date, and information related to a customer's mobile device and location if a customer uses the Wichita Transit's RIDE WICHITA Application or other Wichita Transit trip booking or planning tools.
Aggregate Data or Aggregate Information is statistical information that is derived from collective data that relates to a group or category of persons from which PII has been obtained or collected. Aggregate Data reflects the characteristics of a large group of anonymous people. Wichita Transit may use Aggregate Data and provide Aggregate Data to others to generate statistical reports for the purpose of managing Wichita Transit operations.
Wichita Transit may also combine the PII provided by Wichita Transit customers in a non-identifiable format with other information to create Aggregate Data that may be disclosed to third parties. Aggregate Data is used by Wichita Transit to improve Wichita Transit program and for the marketing of Wichita Transit. Aggregate Data does not contain any information that could be used to contact or identify individual Wichita Transit customers or their accounts. For example, Wichita Transit may inform third parties regarding the number of Wichita Transit accounts within a particular zip code.
Location Data or Location Information is mobile device geolocation data, including, but not limited to geolocation data from GPS, cellular, Wi-Fi services, your mobile device IP address, or other similar technology. Location Data also includes the user's current, past, or future location based on app usage or any route planning, trip planning, or multi-modal tools accessed by the user. If you permit Wichita Transit to access Location Data Wichita Transit may collect, store, and use this data in conjunction with the provisioning of ticketing or multi-modal services. If you permit Wichita Transit to access location services through your mobile device's operating system's permission mechanismWichita Transit may collect, store, and use this data when the Wichita Transit app is active in the foreground or background.
Wichita Transit may also combine Location and Transaction Data provided by Wichita Transit customers in a non-identifiable format that may be disclosed to third parties. This combined data is used by Wichita Transit to improve the Wichita Transit program and system. This combined data does not contain any information that could be used to contact or identify individual Wichita Transit customers or their accounts.
Transaction Data or Transaction Information are details relating to the ticket transactions made to access Wichita Transit services, including, but not limited to ticket purchase, activation, validation, access, and usage.
Account Access and Controls
Registering a Wichita Transit Account is solely within the customer's discretion and is not required for using the Wichita Transit system. The information required to register an account or to obtain other convenience benefits provided by Wichita Transit includes PII such as name, mailing address(es), billing address, email address, telephone number, and, for certain convenience benefits, credit or debit card number, expiration date and Wichita Transit account security code, if any. Wichita Transit may request other information as required by law. Wichita Transit may request other optional information, such as alternate contact information, but in such instances Wichita Transit will indicate that providing such information is optional.
Customers who have registered their Wichita Transit Accounts can review and update personal information at any time, and are also able to modify, add, or delete any optional account information. PII and optional account information can be reviewed and edited as discussed below under “Updating Personal Identifying Information." Wichita Transit customers can close their account(s) at any time by contacting Wichita Transit Customer Service at 316-265-7221.
The City of Wichita and its operating department, Wichita Transit, are committed to ensuring customer privacy and security. Specifically:
- PII from Wichita Transit accounts will not be provided to advertisers for their use;
- Wichita Transit will maintain a secure environment for customer PII.
- Wichita Transit may disclose PII in special cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) Wichita Transit's rights or property, other citizens or business partners, or anyone else that could be harmed by such activities.
- Wichita Transit may disclose user information when we believe in good faith that the law requires it.
Collection of Personal Identifying Information (PII)
If a customer registers a Wichita Transit Account, Wichita Transit collects personal identifying information from applications and other forms submitted by customers to Wichita Transit Customer Service by telephone, mail, facsimile transmission, in person, or by electronic submission through Wichita Transit's website or RIDE WICHITA Application. Wichita Transit also considers data developed as a byproduct of a customer's use of Wichita Transit system (e.g., a registered user's travel routes and times traveled) to be PII if a Wichita Transit Account is registered.
Additionally, Wichita Transit's RIDE WICHITA Application may collect certain information automatically, including, but not limited to, the type of mobile device being used, a mobile device's unique device ID, the IP address of a mobile device, the type of mobile operating system, the type of mobile Internet browsers used on the mobile device, and information about the way a customer uses Wichita Transit's RIDE WICHITA Application. Wichita Transit may use Location Data to determine a customer's location in order to provide certain services available through Wichita Transit's RIDE WICHITA Application and other online trip planning tools. Wichita Transit may also use Location Data, Transaction Data, or a combination of Location Data and Transaction Data to provision or improve the Wichita Transit system. If you do not want your location being used for such purposes, you must take all necessary steps to turn off the location services for your mobile device in the account settings for the device.
How WICHITA TRANSIT Uses Personal Identifying Information
Wichita Transit uses PII provided by customers in order to provide services through Wichita Transit website and Wichita Transit's RIDE WICHITA Application, to effectively and efficiently process enrollments, manage accounts, respond to questions, send customer emails about Wichita Transit program updates, and otherwise communicate with Wichita Transit customers.
Third Parties with Whom WICHITA TRANSIT May Share Personal Identifying Information
Wichita Transit requires outside law enforcement and regulatory agencies to obtain a subpoena for Wichita Transit records containing PII, including location data, unless otherwise required by law, or the law enforcement or regulatory agency articulates the existence of a bona fide emergency requiring immediate access to specific records. Additionally, Wichita Transit may directly disclose PII to appropriate law enforcement where necessary to protect customers' rights, property or safety.
Besides these entities, PII will not be disclosed to any other third party without express customer consent, except as required to investigate and respond to consumer complaints and to comply with laws, such as the Kansas Open Records Act, or legal process served on any current or future Wichita Transit or Wichita Transit Contractors.
Retention of Personal Identifying Information
Wichita Transit and Wichita Transit Contractors will only store the PII of a Wichita Transit customer that is necessary to perform account functions such as billing, account settlement, or enforcement activities.
Security of Wichita Transit Personal Identifying Information
Wichita Transit is committed to the security of customer PII. Access to PII is controlled through administrative, technical, and physical security measures. For site security purposes and to ensure that this service remains available to all users, this government computer system employs commercial software programs to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage. Except for authorized law enforcement investigations and as outlined above, no other attempts are made to identify individual users or their usage habits. Raw data logs are used for no other purposes and are scheduled for regular destruction in accordance with State guidelines for records management and retention. Unauthorized attempts to upload information or change information on this service are strictly prohibited and may be punishable under the Computer Fraud and Abuse Act of 1986 and the National Information Infrastructure Protection Act.
The City of Wichita and Wichita Transit exercise great care and follow industry "best practices" in providing secure transmission of information from your device to our servers and the storage of personal information on our servers, should you choose to store such information in your account. Unfortunately, no data transmission over the Internet or data storage can be guaranteed to be 100% secure. As a result, while we strive to protect your personal and proprietary information to the greatest possible degree, WICHITA TRANSIT cannot fully ensure or warrant the security of any information you transmit to us, and you do so at your own risk. Our systems will always use the current industry standard encryption (SSL -
Secure Socket Layer) for transmission and industry standard protocols for data storage.
By contract, third parties with whom Wichita Transit share PII will be required to implement adequate security measures to maintain the confidentiality of such information.
Wichita Transit does not knowingly engage in business with any company or vendor that uses Spyware or Malware. Wichita Transit does not market detailed information collected from web sessions that can be directly tied to personal information. Wichita Transit does not provide Wichita Transit customers with downloadable software that collects or utilizes any PII.
Customer Obligations and Legal Disclaimer
Wichita Transit customers are responsible for safeguarding personal mobile devices, usernames, passwords, personal identification numbers (PINs), and other authentication information that may be used to access a Wichita Transit account. You are also solely responsible for all activities that occur through your User ID and password. You agree not to access or use, or attempt to access or use, the Services or any part thereof using the identity or the Registration Data of any person other than yourself.
Your Wichita Transit account is password-protected so that only you can access it, use it, and view information relevant to your account. We recommend that you make your password easy to remember but difficult to guess and never divulge this information to anyone. Wichita Transit will never ask you for your password in an unsolicited phone call or e-mail. Ultimately, you are responsible for maintaining the secrecy of your passwords and any account information.
Wichita Transit customers should not disclose authentication information to any third party and should notify Wichita Transit of any unauthorized use of their usernames, passwords, or accounts. Wichita Transit cannot secure PII that is released by Wichita Transit customers to others or PII that customers request Wichita Transit release to others.
In addition, there is a risk that unauthorized third parties may engage in illegal activity, such as hacking into Wichita Transit's security systems or Wichita Transit Contractors' security system, or by intercepting transmissions of personal information over the Internet. Wichita Transit is not responsible for any data obtained in an unauthorized manner, and besides the customer, Wichita Transit is the only entity that may authorize obtaining data from Wichita Transit programs by a third party. Wichita Transit is not responsible for any data or PII obtained by a third party as a result of a Wichita Transit cardholder's negligence or misuse of Wichita Transit fare media, products, or equipment. If a Wichita Transit cardholder's fare media is lost, stolen, or damaged, Wichita Transit is not responsible for any data or PII that is obtained by a third party.
Updating Personal Identifying Information
Customers can review and edit their PII online, from the RIDE WICHITA Application, or by calling Wichita Transit Customer Service at 316-265-7221.
Complaints or problems regarding updating personal information should be submitted by contacting Wichita Transit Customer Service at 316-265-7221 or sending an email to [email protected] Wichita Transit Customer Service will either resolve the issue or forward the complaint to an appropriate Wichita Transit staff member for a response or resolution. Wichita Transit strives to answer all queries within 72 business hours, but it may not always be feasible to do so.
Wichita Transit websites, including www.WichitaTransit.org, store “cookies" on the computer systems of website users to customize your browsing experience. Cookies are simple text files stored by your web browser and they provide a method of distinguishing among visitors to the web sites. Cookies created on your computer by using our web sites do not contain personally identifiable information and do not compromise your privacy or security. We use the cookie feature to store a randomly generated identifying tag on your computer. If you have further questions about cookies, the Computer Incident Advisory Capacity Unit that monitors computer problems for the U.S. Department of Energy issued a study on March 12, 1998, of the risks to users about cookies, titled, "Information Bulletin 1-034: Internet Cookies". You can refuse the cookie or delete the cookie file from your computer at any time by using any one of a number of widely available methods. Your choice to refuse the cookie will not inhibit your access to any of the information available on the Wichita Transit website (with the exception of those applications that require a cookie for functionality). Personal Information of Children Under the Age of 13
Pursuant to the Children's Online Privacy Protection Act, 15 U.S.C. 6501 et seq. children under 13 years of age must have permission from a parent or legal guardian before providing personal information on a Web site or application. Wichita Transit complies with the requirements of the Children's Online Privacy Act (COPPA) and the FTC's Rule interpreting COPPA (16 CFR § 512).Wichita Transit's website and Wichita Transit's RIDE WICHITA application are not directed to children, and do not knowingly collect any personally identifiable information from children under the age of 13 without parental consent. If Wichita Transit learns that it has personal information on a child under the age of 13 without parental consent, access to that information by the child or any third party will immediately be denied and the information removed from the system.
Wichita Transit hereby certifies strict adherence to the Kansas Open Records Act (KSA 45-223). As such, this site is controlled by Wichita Transit which is an operating department of the City of Wichita in the State of Kansas, USA. Therefore, the laws of the State of Kansas will govern these disclaimers, terms, and conditions, without presenting any conflicts of law. Wichita Transit reserves the right to make changes to this site, the disclaimers, and the terms and conditions at any time.
