Auto Wrecking

Any person engaged in the business of buying, acquiring, or dealing in motor vehicles to be wrecked, dismantled, or disassembled, or anyone who maintains or uses any building, premise or place to wreck, dismantle, or disassemble any motor vehicle and who sells the parts thereof.

Any person who advertises, conducts, or carries on in the city any sale of goods, wares, or merchandise at retail that is represented as a business termination or stock liquidation sale.

Cereal Malt Beverage

Any fermented but undistilled liquor brewed or made from malt or from a mixture of malt or malt substitute, but does not include any such liquor which is more than 3.2% alcohol by weight, for use or consumption and not for resale in any form.

On-Premise Consumption: Consumption of cereal malt beverage ON premises for Taverns (less than 50% of gross revenues derived from the sale of food), General/Restaurants (more than 50% of gross revenues derived from the sale of food), etc.

Off-Premise Consumption: Consumption of cereal malt beverage OFF premises for grocery stores, convenience stores, etc.

There are three different types of applications with one that must be completed depending on the type of business:

  1. Individual/Sole Proprietor and the City of Wichita Supplemental Information Application for Individual;
  2. Partnership, Firm or Association and the City of Wichita Supplemental Information Application for Partnership/Firm/Association;
  3. Corporate and the City of Wichita Supplemental Information Application for Corporation.

Common Consumption Area

A Common Consumption area is a defined indoor or outdoor area which is not otherwise licensed by the Kansas Liquor Control Act or the Club and Drinking Establishment Act where the possession and consumption of alcoholic liquor is allowed pursuant to a common consumption area permit. It is unlawful for any person within the corporate limits of the city to consume or to have in such person’s possession any open container of alcoholic beverage upon the public streets, alleys, roads, sidewalks or highways, or inside vehicles while upon the public streets, alleys, roads or highways except such streets, alleys, roads, sidewalks or highways have been closed to motor vehicle traffic by the City Council, and a temporary permit for a special event has been issued and the City Council has approved consumption of alcohol at the event or the area is licensed as a common consumption area.

Cultural Market

A Cultural Market is an outdoor place or market area that operates upon city owned property pursuant to a lease or management agreement, and where multiple vendors gather to sell merchandise as designed to promote the purpose and goals of agricultural market. Products that may be sold at such a market would typically include, but are not limited to, locally grown produce, fine arts, ceramics, pottery, plants, flowers, ethnic crafts and handicrafts, blankets, toys, jewelry, clothing, original artwork, and prepared foods as approved by the City of Wichita Environmental Services Division, including food sold from trucks, carts or other vehicles. A cultural market site will also be available for community events and cultural celebrations designed to promote the purpose and goals.

Farmer's Market

A Farmer's Market is an outdoor place or market area with a formalized location where more than one Kansas farmer or grower gathers to sell agricultural products they have grown or raised. Other activities and other sellers may be accommodated at the market, but the sale of agricultural products shall be the focal point of the market activity.

Other products that may be sold would typically include:

  1. Dried flowers, plants and nursery products
  2. Crafts and handicrafts that are made in the home Original artwork
  3. Certain prepared foods such as baked goods, preserves, pickles and cheese (as approved by the City of Wichita Environmental Services Department)

Ice Cream Vendor

Any person, firm, partnership, or corporation who travels by any type of vehicle from house to house or place to place, selling or offering for sale any ice cream foodstuffs within the city limits of Wichita. No person, firm, partnership, or corporation shall be considered an ice cream street vendor when orders are taken for ice cream foodstuffs to be delivered on a day other than the date of sale.

Liquor License

The Liquor License is required for any person who operates a Drinking Establishment, Drinking Establishment/Restaurant, Drinking Establishment/Restaurant/Event Center, Drinking Establishment/Hotel, Drinking Establishment/Caterer, Class A Club, Class B Club, Caterer, or operates pursuant to a Temporary Permit must first obtain a liquor license for such business as issued by the City of Wichita.

"Alcoholic Liquor" means alcohol, spirits, wine, beer and every liquid or solid, patented or not, containing alcohol, spirits, wine, or beer and capable of being consumed as a beverage by a human being, but shall not include any cereal malt beverage.

Miscellaneous Sale, Garage Sale, Etc.

A miscellaneous sale is any garage, basement, yard, rummage, or other similar sale of 6 or more items that were originally purchased by the applicant for his/her use or consumption.

Mobile Food Vendor

A Mobile Food Vendor license is required for any person or persons engaged in the operation of a Mobile Food Unit. This license does not apply to persons catering a private event not open to the general public, to ice cream trucks licensed and operating pursuant to Chapter 3.89 of the City Code and which sell ONLY ice cream stuffs, to sidewalk vendors licensed and operating pursuant to Chapter 3.97 of the City Code, or to door-to-door sales or delivery of prepared food not intended for immediate consumption. The license does apply to the sale of agricultural, farm, garden or aquacultural products or fruits grown within the State of Kansas by producers or growers and their agents.

A Mobile Food Unit means any self-contained vehicle, trailer, cart, wagon, or other type of conveyance from which any food and/or beverage is offered for sale.

Pawnbroker

Any individual, firm, company, partnership, corporation or association who loans money on deposit or pledge of personal property or other valuable item, other than intangible personal property, or who deals in the purchase of personal property on condition of selling the same back again at a stipulated price, or the employee of such persons, but such terms shall not include any person operating under the supervision of the State Banking Commissioner, Credit Union Administrator or the Consumer Credit Commissioner of this state.

Precious Metal Dealer

Any person engaged in the business of purchasing precious metal for the purpose of reselling such metal in any form or the employee of such person. Precious metals means gold, silver or platinum group metals or any used articles or other used personal property containing such metals, but shall not include coins purchased for their numismatic value rather than their metal content or ingots or other industrial residue or by products composed of such metals purchased from manufacturing firms. Secondhand Dealer

Any person, firm, company, partnership, association or corporation or their employee engaged in the business of buying, selling, trading, exchanging or otherwise dealing in secondhand merchandise of any sort or description, whether or not he or she deals in other goods and regardless of where goods are bought.

Street and Sidewalk Vendors

“Sidewalk Vending” means engaging in the business of peddling, vending, selling, or displaying for sale any merchandise or food item, when both the vendor and the vendee are upon a public sidewalk or sidewalk area in the Central Business District. This does not include food vending machines. The City does not require licensing for food vending machines (only tobacco vending machines and establishments where pre-packaged food is stored).

“Street Vending” means engaging in the business of ped​dling, vending, selling, or displaying for sale any merchandise or food that occurs while the person travels by foot or any type of conveyance from house to house or place to place, or when such merchandise or food is presented from a vehicle, cart or stand outside the Central Business District.

Central Business District means that area of Wichita bounded by:

  1. Lewis Street, the Arkansas River, Central Avenue and the elevated tracks, and;
  2. Douglas Avenue from the Arkansas River to Seneca Street.

Any person selling or dealing theater or amusement tickets at a price varying from the regular advertised box office price in the city.

Any establishment selling cigarettes or tobacco products at one or more locations within the city. This includes tobacco vending machines.

Transient Merchants

A person shall be deemed a transient merchant and the requirements of this chapter shall be applicable to such person regardless of whether the person is sponsoring or operating the activity in question or is participating in the activity as a seller or exhibitor. “Merchandise” means any goods, wares, food, food products, agricultural produce, flowers, or any product of any kind that can be bought and sold.

Any person engaged in the business of:

  1. Transacting any temporary or transient business of selling or delivering any merchandise within the City.
  2. Exhibition and sale of such merchandise who hires, leases, uses or occupies any building, structure, motor vehicle, tent, railroad boxcar, boat, public room in hotels, lodging houses, apartments, shops or any real estate within the City.
  3. Selling or offering for sale merchandise from locations within doorways, lobbies or areaways shall be included in the definition of these terms and shall be subject to the provision of this chapter only when such sales or merchandise are to pedestrians on or within any public right-of-way.
